I think the logic is he should not have to be bothered with a trial if he is right about being immune. Not because it's more efficient to do the appeals pre-trial.

There was nothing in the order that barred federal prosecutors from continuing to proactively provide discovery or file motions even though the deadlines were lifted.

Yeah, this is basically what I’m saying in my posts above.  Trump’s job-based immunity claim is at least in part a factual question that should be first adjudicated at trial.

He is also making a double jeopardy argument which I guess is supposed to be heard beford trial, but this particular part of the appeal is almost certainly the stupidest of all of them.

A couple key takeaways. The tweet about Mike Pence didn't do his job (led to the calls to hang him) came from Trump's thumbs. The tweet calling for the rioters to stay peaceful was sent by Scavino.

Specifically they are arguing that he would be immune from prosecution unless he were impeached and convicted first. Even though Senate Republicans said that the reason they weren’t voting to convict him in 2021 (purportedly) was that he should be tried in court instead of being impeached and convicted!
