If Trump is convicted for the Conspiracy Against Rights charge under Section 241 of the US code, he is eligible for the death penalty. The reason for that is that January 6 resulted in deaths.

I don't think that will actually happen, but theoretically it is apparently a possible punishment.

https://www.law.cornell.edu/uscode/text/18/241

Quote
18 U.S. Code § 241 - Conspiracy against rights

If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; or

If two or more persons go in disguise on the highway, or on the premises of another, with intent to prevent or hinder his free exercise or enjoyment of any right or privilege so secured—

They shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death.

Former VP and active presidential candidate becomes witness against former President and active presidential candidate in criminal indictment. Somehow the real world seems to have become as far-fetched as shows like House of Cards, Designated Survivor, or Scandal.

So will the jury consist only of DC residents? If so, it’s more likely than not to include zero Trump voters.

DeSantis' tweet reads like a bad parody.

He even manages to insult the citizens of the nation's capital which goes to show what he thinks of American voters who aren't likely to vote for him ("Washington, DC is a “swamp” and it is unfair to have to stand trial before a jury that is reflective of the swamp mentality.").

Would it be better for Trump to request a Bench Trial here or no

I think so. See https://www.dcd.uscourts.gov/sites/dcd/files/D.D.C.JurySelectionPlan-20220517.pdf

Quote
It is the policy of the United States and this Court that all litigants entitled to trial by jury shall have the right to grand and petit juries selected at random from a fair cross-section of the community. It is also the policy of the United States and this Court that all eligible citizens who reside within the District of Columbia shall have the opportunity to be considered for service on grand and petit juries and they shall have an obligation to serve as jurors when summoned for that purpose.

What a weak reply by DeSantis

Ramaswamy was on Fox just minutes ago. He cited a Court case that indicated that candidates are allowed to lie (which should protect Trump’s dishonesty during 2020), he says a president shouldn’t be indicted on novel theories, and he cites DOJ’s response to his FOIL result to argue that the DOJ should be mistrusted

Unlike DeSantis, Ramaswamy and Pence have at least given decent responses to the indictment … how can DeSantis just admit outright that he didn’t read the indictment

I'll always give credit to people who admit they're wrong. Don't sweat it. Everyone has a primary candidate that they fall in love with that fizzles out.

Kangaroo court.

I see you at least have the decency to change your avatar name before spouting stuff like this. Still, your original namesake would be ashamed of Trump.

These parts of the indictment are interesting. Charging Trump for his actions while the insurrection was already underway doesn't run into the same potential 1A issues that would have come with inciting the riot via his rally beforehand.

Would not have been as big of a problem if Trump was not running as him collapsing would not lead to our nominee being someone who is indicted of basically intentionally harming our national security and showing no regard for the rule of law.

I will not support Pence, but I acknowledge that speaking honestly like this is unlikely to do him any favors in the GOP, and respect that it took some courage to do so. (That it is, is damning to the GOP as a whole, but I still think its true.)

I would certainly prefer him over Trump for the Republican primary.

I've been banging away at this for months: His candidacy only ever made sense in a universe where Trump didn't run. This statement is yet another example of that. This is the statement you give when Trump isn't running and you want to win over the primary voters who would have supported him.

The biggest problem for any Republican who wants to beat Trump is they have to find some way to get "Soft" Trump supporters on their side without losing anyone else . Its probably extremely difficult to thread that needle and I dont think any of our candidates are capable of really doing that.

Thought I'd share this here too from ABC:

Quote
Fitch informed Biden administration officials that the Jan. 6, 2021 insurrection was a factor in its decision to downgrade because it indicated an unstable government, according to a person familiar with the discussions between the administration and the rating agency. Fitch produced a report last year that showed government stability declined from 2018 to 2021, but increased since Biden assumed the presidency, said the person, who was granted anonymity to disclose private conversations.

https://abcnews.go.com/Business/wireStory/fitch-downgrades-us-credit-rating-citing-mounting-debt-101919526

Ironic he's getting indicted today seeing as how he damaged America's credit rating from this stunt.
