I regret ever saying or thinking "there will never be an election decided by 1 vote" or something like that

How about a final vote of 1-0?  http://thehill.com/homenews/campaign/362934-philadelphia-write-in-candidate-shocked-by-surprise-victory

This was an uncounted overvote (not a Simonds vote), so if counted the result would be a tie.

Per this thread, it sounds like there's a pretty good case to count it for Yancey.  No official result yet.

I’m soooo happy I called as to close to call yesterday.
This is insane that a flip if a coin is going to decide the entire control of the HOD.

Just out of curiousity, what is the geographic similarities and differences between Norfolk, Hampton Roads and Virginia Beach?

I also think somebody should put a minor league soccer team back in that area.

It could get much more insane.  Apparently VA election law allows the loser of a coin flip in a tied election to request a recount.  So you could get an infinite loop of coin flip, loser requests recount, result is another tie and coin flip, loser requests another recount, etc. Smiley

However, there's also a provision that says there may be at most ONE recount for a race, which would appear to conflict with that idea.

Expect this one to end up in court.

Still in recess. There is a letter from an observer that says both candidates’ bubbles were filled. Simonds bubble had a strike through it. Rest of ballot was all for Republicans.
More to come. Back to court

Looking at a drawing of the challenged ballot here, I'm now less convinced of Yancey's case and more inclined to think that throwing it out as an overvote was the correct call.  You can make a guess as to the voter's intent, but it's not a slam dunk; there's certainly room for doubt IMO.  The voter should have asked for a new ballot and started over.

Aren't there still two or three disputed Simonds ballots?

I think they dropped the challenge on that when they were up. Might bring those up now.

Here's (roughly) what that ballot looked like:

The cross on Gillespie’s name IMO makes determining intent impossible for the delegate race. I don’t see how they decided counting this ballot was acceptable.

BS

For the record, this 2008 MN Senate Ballot was rejected as an overvote.  This ballot is more clear than that ballot.

The judges should NOT have counted this ballot. It is an overvote. Votes like these were rejected when I worked the polls in 2008. People need to follow directions and ask for a new ballot if mistakes are made. Clearly this voter didn't.

So they draw lots in the event of a tie, but the loser of the lots drawing gets to request another recount. If it stays a tie in the 2nd recount, I would assume they draw lots again, after which the loser could request another recount. Basically, this might go on until the recount changes from a tie.

So at present, there's a 50-50 chance that the HoD will be divided 50-50.  I hereby dub this "Schrodinger's Election".

Yancey was on Pascale's live stream as of a second ago (it just ended). They will certify the tie but it will be up to the Board of Elections to decide the method of the "lot" coin, straws, etc.

First tie in VA history.

Wait, isn't Greedo's gripe with the 2004 Washington race the fact that they did multiple recounts? But now he wants a second recount here? lol
Okay the difference with Washington 04 and HD-94 is

Yancy won the first count by 10 votes
Rossi won the first count by 250ish
Yancy lost the second count by 1 vote
Rossi won the second count by 40ish votes
Rossi then goes on to lose in the third count by 110ish votes

So the reason I want a recount is because the result changed in 04 the first 2 counts were the same.

In the Virginia it changed with yancy losing by 1 vote I think that when there is a recount that changes the actual result they should do a extra count.

There should have been a third count in Minnesota in 08 and a fourth count in Washington in 04.

That's a fair point. Honestly, in a race that is decided by a single vote, it wouldn't be surprising if the result changed each time you recounted. In something that close, even 99.99% counting precision wouldn't be enough to give a clear victor.
So it looks like we agree then that a third count would be good to sort out any errors there could be.

Actually my point was that in a race this close you'll never be completely sure of the victor no matter how many times you recount, as we just saw, lol.
