According the lawyer on the live stream, the VA rules that the panel were following were to utilize positive intent and try to count the ballot even though it was an overvote. Clearly, Virginia needs to add a definition into the code that establishes that demonstrable overvotes are not to be counted, intent or no, in determining a victor.

Voters need to follow damn directions.

Here's (roughly) what that ballot looked like:

Lol you can all cry but that person voted republican so yes it is a tie.

Why are Republican voters too godamn stupid to follow kindergarten levels of directions for filling out a ballot?

This just seems to be a matter of by-the-book vs. intent. I thought going by the book was the standard everyone used?

The hackery in this thread is getting intense. All of you would be celebrating (or mourning in Greedo's case) if the exact same scenario happened in reverse and you know it, so stop whining.

Virginia law calls for them to interpret intent if that's clear.  In this case, I don't think it's clear.  If I had to bet, I'd say the intent was for Yancey, but that's a judgement call; there's room for a reasonable doubt, so the ballot should be discarded.

That is what I figured as well. It appears the VA rules are by intent and not a strict by the book rules interpretation of the electoral laws. That is a major flaw, imo. Voters should follow exact directions and if the ballot is an overvote, it should be discarded as such. I fault the poll workers here as well because they should have known that and had the voter revote with a fresh ballot.

Consider this:

This ballot right here for MN-Sen 2008 was rejected as an overvote.

In this case, it is 100% obvious that they wanted to vote for Franken.

In the case of this, it is not clear how the voter intended, yet they count the vote?

Does MN use an intent standard, though? Because it appears VA does.

Different then the VA issue.
That person wrote in lizard people for president and senate so I’m going to guess that person is a troll.
This Virginia ballot is a typo why would someone vote for Gillespie Vogel and Adams then vote dem for the HOD? They saw they filled in the wrong box and fixed it.

The MN person circled the box for Lizard People for Pres, but left the Sen box un-circled.

The VA ballot also had a cross out for Gillespie, not just for Simonds.  And there were more crosses in Gillespie.

This ballot was not found in like a trash bag unlike Washington or Minnesota.
It’s a ballot they didn’t want to count because of over voting but tome it’s clear that this person voted republican for HOD and made a typo.

But that person didn’t fill in anyone else for governor.
Plus this person still voted for Vogel and Adams so I’m going to guess that this person made a typo and it should be counted.

Please remember that there are two Simmonds ballots that haven't been added to the count yet.

I don’t think taking the rest of the ballot in context is a good idea, honestly. It opens up a whole can of worms as precedence.

What if the ballot was a Gillespie/Fairfax/Adams ballot, or any other non-party-line ballot?

You should only take the vote in question in consideration; not the rest of the ballot.

This reminds me of when a Liberal Democrat claimed that a penis next to his counted as a vote.

The Gillespie box was even messier than the Simonds box in this case.  Maybe they intended to leave a blank ballot for the Governor race by your logic!

Yes they are. Also, for the record, all Virginia ballots have the rules in a box on the top of each ballot enumerated and plain as day. The judges should have taken that into consideration.

Sounds like both were counted.
