But this court has 3 conservatives, 3 libertarians, 1 liberal (me), 1 populist (you) and 1 centrist (Gabu). This gives it a fairly clear conservative majority on economic issues although you can count on Cashcow, Alcon and Supersoulty possibly crossing over, making it more swing. Gabu will probably end up being the swing vote.

On social issues there's a 4-4 tie with Gabu being in the middle. While he probably leans left socially, he could conceivably cross over many times. Once again, Gabu is the main key vote, and thus an appropiate pick for CJ.

Eh, I like all of you guys, for one thing Smiley  But, I think generally you're all of sound rationale and well-versed in issues of importance.  There are partisans among the group, to be certain, but I have no doubt that many cases that come before the court could be thoroughly debated and challenged with these nine on the bench; not to mention the more moderate members of the group could be persuaded by strong and sound arguments, though they have the capacity to do plenty of strong reasoning themselves.  I did try to pick a mixed group of individuals -- a court that is too far in one direction or the other is not my idea of a healthy court.

As for a deeper, ideologically-based rationale -- BRTD and States represent the extremes of the court, and everyone trends inward towards a moderate center -- either Gabu or WMS would fit that bill, in my opinion.  Alcon comes close.  I think it would be a really solid court, though there are a few others on the board that would make great additions as well.

I doubt that. Peter Bell and Ernest, for example, believe that the "right to privacy" is constitutionally protected.

The court is fairly evenly balanced, actually, between five originalists/conservatives and four non-originalists/liberals.
