(I tried to give this one some good balance.  I think if I've done my math right that this court would rule against both abortion and the death penalty.  The Chief Justice would be a swing voter on both issues.  Such a court would also uphold gun rights and likely label affirmative action unconstitutional.)

That's a good list (if I'm in a partisan mood), but all but three or four of those nominations probably couldn't get past the current Senate.  Tongue  Seriously though, I think any court should have a good balance between liberals, conservatives, and libertarians.  If you pick the right people you can usually get the rulings to go your way, while still maintaining a healthy balance that pleases everyone.

Interesting list. It's probably the most balanced one so far. Hughento's is very balanced as well; having Bono and Texasgurl on the same court seems like an interesting prospect.

Jake's court is somewhat right-wing, BRTD's extremely left-wing, and mine quite libertarian.

You seem to have two populists (Al and Supersoulty), two liberals (thefactor and Ebowed), one conservative (dazzleman), and four libertarians (John Dibble, Peter Bell, KEmperor, and me).

The court would definitely swing towards the right on economic issues; I think that the four libertarians and dazzleman would be quite consistent on the matter (although Peter Bell might become a swing vote when it comes to the commerce clause, etc.). Gun rights would also be protected.

The court's rulings on abortion might be difficult to predict. Ebowed is of course opposed to the idea of a constitutional right to have an abortion; I believe that dazzleman, Al, and Supersoulty are as well. Peter Bell does not hold that there is an absolute right to an abortion, and may become a swing vote. Also, I don't know if Dibble and KEmperor would strike down state laws against abortion.

So, in effect, I think that Peter Bell would be the swing vote on many issues, the Sandra Day O'Connor of this bench.

The Court would probably break down thus: two conservatives (dazzleman and PBrunsel), one populist (Al), and six libertarians (the rest).

On economic issues, I fear that Al might be outvoted 8-1 on some occasions. However, he might be joined by some of the more moderate libertarians (Peter Bell and Ernest), and perhaps even by PBrunsel, in a few cases. Still, the economic conservatives have a 5-4 majority at worst.

The court would probably make liberal decisions about social issues at the federal level by 6-3 votes, or possibly even 7-2 in some instances. It is difficult to predict, in my opinion, how the court will deal with the states. I know that A18 is firmly opposed to the doctrines of substantive due process and incorporation. I can't really say about most of the other libertarian judges; however, all five of them would have to vote together on social issues at the state level. Peter Bell, Ernest, or JFK could become a swing vote.

So, on the whole, there is no single Justice who would be the swing vote, as far as I can tell. I would expect the greatest number of dissents to come from A18 on the one hand and Al on the other.
