History question:  What happened when President Reagan nominated Justice William Rehnquist for Chief Justice and then nominated Antonin Scalia for the position of Associate Justice?

I just returned after a two day absence to find these Presidential actions under the Christmas tree.  I believe we on the Court have a responsibility to refrain from direct commentary upon any nomination, and I further believe that any negative comment is potentially detrimental to the future operation of the court, as well as an unconscionable attempt to influence the process.

Let us simply take the good with the bad, and keep our counsel.

Wouldn't the hearing on Maro have to wait until after a hypothetical confirmation of the man whose opinion in a certain case I'm still waiting for?

When I was promoted to Chief Justice, my hearing and Emsworth's were opened at the same time (he was succeeding me as Associate). The difference was that my vote opened and then confirmed me before his vote was able to open. In this way, a long delay before we have a fully operational court can be avoided.

Because a hearing doesn't actually involve anything about actually filling the seat. I believe the vote for J. Spade would have to come first though.

Teddy had asked if he could do it, and EarlAW had seemed interested, but I don't think it ever came to pass. You could appoint Teddy as Deputy SoFA now though, just to be certain.
