The common denominator here is Bragg.

A grand jury voted to indict. It wasn't solely up to the District Attorney.

As much as I'm enjoying Trump being charged today, I will just state for the record, I don't *really* care all that much about this case: Fulton County is the one that is going to matter the most in the end.
Fulton is twice as republican as Manhattan.

Remember a single Trump voter on the Jury would probably sink it just as an all Biden Jury would probably convict.

If they can't convict him in Manhattan I doubt they will get a Jury more favourable.

You're assuming that the juries will evaluate the case on politics and not the charges. Plus during the jury selection process there is thorough vetting for bias one way or another.
I'm practical.

It's a Celebrity trial, so of course they will probably evaluate the case on personal beliefs regardless of the evidence, like in most celebrity trials.

And even if you can get a Jury made up entirely out of Libertarian Party voters they will still be unable to unanimously agree, they will always be at least 1.

Well, another issue (yeah, it is like a law school exam, I wonder how Dule would do), is the issue of whether a state NYS statute of limitations on a state law can be extended based on the cover up involving a federal law. Should NYS be taking cognizance of “foreign” laws as to which it has no specific interest?

The issue is one of first impression in NYS.

And would Dule spot the SCOTUS “rule of lenity” issue? Yet another uber esoteric issue to
spot; f*uck, this exam is a bit*h.

“The Supreme Court has long held, under a doctrine known as the “rule of lenity,” that “fair warning should be given to the world, in language that the common world will understand, of what the law intends to do if a certain line is passed.” Thus, when the meaning of a criminal statute is unclear, the Constitution sometimes requires that statute to be read narrowly because an unclear criminal law did not give potential defendants “fair warning” that their conduct was illegal.”

After spotting the issue of course, the next hurdle is to weigh the merits. The “correct” answer of course is that the gravamen of the lenity rule arises from equitable principles, not legal ones (yes I know this is where we lose all the laypeople, bye folks), and there is no "fair notice" issue, because Trump’s escape hatch is the statute of limitations. Trump certainly had fair notice that if caught in 2 years as to his multiple frauds, he’s done.  So, Trump had fair notice that what he did was unlawful as and when he did it. And thus, the concealment.  Equity here if it exists is not on this planet, and probably nowhere in this universe.

In this case, what happens at the appellate level in NYS (the intermediate court, not the highest court, called the Court of Appeals in NYS), really matters. Given the politics, and a 3-3 court with a vacancy, the high state court taking the case and overturning it, would be very bad optics, on such a highly technical issue.

Barr abused his office to shut down what would have been a federal investigation into the same conduct Bragg is now charging Donald for. Just to be clear.

Since the 2016 campaign, all kinds of people have raised expectations regarding Trump's imminent demise as a political force, a President, a free man, etc. Whether they be the lamestream media, Democratic (and a few Republican) politicians, prosecutors, intelligence officials, and all manner of other “pundits” both professional and armchair offering their ongoing Twitter and Cable TV commentary on Trump’s controversies, there've been a lot of people with large audiences and influential platforms promising that career criminal, fascist-curious, unprecedented internal menace to American democracy Donald John Trump, Sr. is "about to face real consequences." Whether it came from the SDNY, FBI, impeachment, the military, or the vaunted "adults in the room" during the Trump Presidency, there were a lot of people making promises that someone, somewhere, would Stop Him.

All of the above has backfired. It has benefited Trump politically (and by extension, financially), played into his and his supporters' persecution complex about the Lyin' Media/Deep State being "out to get them", made his opponents look impotent, silly, and tiresome, and created staying power for Trump that he may very well not have otherwise had----at least, not as a political force post-Presidency.

Trump still should face serious criminal consequences for January 6th. For Christ's sake, he and his supporters wanted to hang his own Vice President, along with the Speaker of the House and every other Democrat and "RINO" in Congress! This is a man who should have been indicted two years ago!

Well, this ended very anti-climatically. No perp walk in handcuffs. No mug shot. Immeditatly released. Trial is probably a year away at minimum. Which Trump will probably win or get off with a fine/community service. Very few people go to jail for lying on taxes or busieness documents. Especially the rich. And for things much worst.

Fulton and DOJ are better chances to ruin his career and jail time. But I suspect that'll never happen. If anything, it'll boost sympathcy turnout for MAGA and win over some surbuban republcians who might not like Trump but view this whole case as a sham.

But I've been wrong in this very thread. Who knows...
