Portman also has returned a blue slip for Bloomekatz to the 6th Cir, Young and Braun turned in their blue slips for Doris Pryor to the 7th, so did Toomey for Cindy Chung for the 3rd, and Kennedy for Dana Douglas to the 5th.

That's certainly good news, although circuit court blue slips aren't necessary like they are for district court nominations. I did read about the Pryor nomination having support from both IN Senators. I wasn't aware of the others though. Bloomekatz is a big one though, because I could easily see her getting top tier consideration for a seat on SCOTUS.

I'm still wondering about the KS seat on the 10th Circuit (I don't expect cooperation there) and the SC seat on the 4th Circuit (apart from KBJ, Graham has been quite fair and reasonable). There's also an impending vacancy for a TX seat on the 5th. It's possible to work with Cornyn, but Cruz is impossible.

Nomination by the end of this month is probably the cutoff for a shot at getting confirmed this congress, so unless Ds retain the Senate, Biden probably doesn't get to fill (most of) that last paragraph.

If Republicans control the Senate after the midterms, she's the obvious pick for any potential conservative vacancy (apart from perhaps Roberts himself as CJ). I'm sure they'd find some reason to prevent action, but it would definitely make them squirm like nothing else.

It looks like the Senate is slacking on judges. I can't even blame Biden for this anymore. He just nominated ten more judges (including two more circuit court nominees). That leaves only 7 circuit court seats without nominees. If every circuit court nominee named gets confirmed, that would be 34 circuit judges in two years. I would not be disappointed with that number. For reference, the past few Presidents in their first two years:

Trump: 30C/53D
Obama: 16C/44D

It looks like the Senate is slacking on judges. I can't even blame Biden for this anymore. He just nominated ten more judges (including two more circuit court nominees). That leaves only 7 circuit court seats without nominees. If every circuit court nominee named gets confirmed, that would be 34 circuit judges in two years. I would not be disappointed with that number. For reference, the past few Presidents in their first two years:

Trump: 30C/53D
Obama: 16C/44D
GWB: 17C/83D
Clinton: 19C/107D
GHWB: 22C/48D
Reagan: 19C/68D
Carter: 12C/48D

Schumer's in a tough spot with the evenly divided Senate. Aside from the few months between Doug Jones swearing in and McCain dying, McConnell always had at least a little breathing room. And McConnell basically didn't have to worry about a virus taking people out of commission, even when he did he had 53 seats. Only so much Schumer can do in this situation.

Agreed, still pretty good what Biden and Schumer accomplished. I think Chuck Schumer overall has been a skillful leader given the circumstances. He deserves more credit than he usually gets.

Hopefully Democrats can add seats this year. Pennsylvania, please elect John Fetterman.

McConnell also changed the rules in 2019 to reduce debate time for district court nominees from 30 hours to 2 hours. Those are the rules today and likely explains the success rate there. I'm concerned about the circuit court nominees, which still require 30 hours of debate. My understanding is that Schumer can file for cloture at the end of the week so that they can be brought up for a final vote the following week. I know some of these votes are tight, but most of them have the usual three (Collins, Murkowski, and Graham). Florence Pan just managed to get Grassley's vote in committee.

I also think they've been taking too much time off. I certainly wouldn't mind seeing some Friday votes for once.

At least Pat Leahy is finally returning to work next week.

I don't think they're doing a bad job. It's just that Trump and McConnell did so much damage to the judiciary in such a short time. They also didn't leave Biden much in terms of open seats to fill. There were literally only two open circuit court seats when Trump left office.

And yes, of course, I want to see Democrats stay in control of the Senate. In terms of judges though, we can't act like that's going to happen. Ideally, get as many circuit judges confirmed before the election and adjust the lame duck depending on what happens. I don't think I need to tell you what happens if McConnell is back in charge of the Senate.

The problem is that to take less time off or hold hearings on nominees, they’d need the whole caucus to vote in favor of doing so and Sinema has been pretty adamant about refusing to vote for the Senate schedule to be modified in any way that would keep it in session for a greater number of days.  Her excuse for this has essentially (and in at least one case explicitly) been some version of “I make my vacation plans in advance and I’m not cutting my vacations short.” 

This really isn’t Schumer’s fault.  He’s got the unenviable task of always needing the votes of 1) a notoriously petty prima dona ConservaDem from one of the most pro-Trump states in the country who has both corporatist tendencies, a tendency to randomly oppose major policies he once supported for completely arbitrary/nonsensical reasons, and a vested personal financial stake in blocking any climate change legislation; as well as 2) an amoral corporate shill who largely relies on Republican mega-donors for fundraising, enjoys trolling for attention on high-profile issues, and has explicitly stated on at least one occasion* that the main reason she hasn’t switched parties is that she thinks her bisexuality would make it impossible to win a primary (Sinema). 

As a result, Schumer has all the burdens and expectations that come with being Majority Leader, but none of the benefits or power because the Democrats don’t have a true majority in the Senate.  Manchin is his own weird situation and Sinema is a DINO. 

The House is a little different although even there, you have folks like Jared Golden (who generally votes like a Republican), Kurt Schrader (who is an even bigger DINO than Sinema), and Josh Gottheimer (who isn’t quite a DINO, but often votes like one b/c he’s a bought and paid for corporate shill who has been a saboteur on multiple occasions).
