There is no excuse. Duckworth should've been there and Harris could've broken the tie. If not, Schumer should've delayed the vote. It's a minor setback, but it is embarrassing. Schumer needs to get it together.

Since Cloture was already invoked, the vote was automatic once 30 hours passed. It was held early, so Schumer could have delayed it for a few hours, but it's unlikely that would have changed the outcome. Pushing it later would have required UC, which the GOP would not have granted as they want to stop this nomination. Schumer could have returned it to the calendar, but then Cloture would have to be re-invoked. So letting the vote happen is actually the best option - if there's surprising support for the nomination, great. If not, he just votes No and files a motion to reconsider, and then the nomination can be brought back up whenever attendance is better, without having to re-invoke Cloture or get UC.

That's a fair explanation, but Schumer should've known Hassan wasn't going to be in town. I don't know where Duckworth was. The Freeman nomination was always going to be one of the most contentious circuit court nomination.

It's also worth noting that Brad Garcia got through committee with Graham's vote, so he won't need a discharge vote. That's almost extraordinary really. He was born in 1986 and is about to get a life appointment to the DC Circuit, the second most powerful court in the country. Even a decade from now, he would be a young candidate for SCOTUS. I honestly expected Democrats to have to jam his nomination through.

It does seem possible that Democrats could get the remainder of all of President Biden's circuit court nominations through to confirmation by the end of the year. It probably depends on whether or not Democrats hold the Senate or not. If we keep a Democratic Senate, some of them will probably pushed into the new Congress. If there's a Republican Senate elected, Democrats basically have to get them all done by the end of the year. Biden does appear on track to surpass Trump's recent record regardless. I think Democrats can get above 30, but getting all 37 probably only happens if Democrats lose the Senate (since any unconfirmed nominees could and would easily be reconsidered in a continuing Democratic Senate in 2023).

A rather disappointing week for judges overall, but it's always good to see a Democratic President get another judge on the DC Circuit. Her confirmation vote for this seat was nowhere close to what she got for the DC District, which is certainly to be expected. Apart from the usual Republicans, she somehow got Portman and Rounds. It's not the first time I've seen Rounds break away from the majority of his party. I wonder if it's the fact that he used to be a governor (and while definitely conservative, he didn't seem to be a firebreather).

Assuming Brad Garcia gets confirmed, President Biden will have secured the DC Circuit for at least a generation. The oldest of the six (hopefully seven) Democratic appointees is Nina Pillard, who is 61. The only potential opening on the right-wing of the court is GHWB-appointee Karen Henderson, although she doesn't seem like the type to leave voluntarily under a Democratic President.

Btw, if anyone doubts how serious Democrats are taking the courts now, Biden has nominated Julie Rikelman for a seat on the 1st Circuit. She represented the "Jackson" in Dobbs v. Jackson. She just had her committee hearing on Wednesday. Unfortunately, she'll probably require a discharge vote, despite how relatively inconsequential the 1st Circuit is.

(I have to say it's also such a shame that Sri Srinivasan isn't a Supreme Court Justice. If there was a reasonable Senate in 2016, he likely would've been confirmed on a strong bipartisan vote. I have no doubt he would've been Obama's pick to succeed Scalia if he knew the Senate would've given him a fair hearing and vote.)

Why?  We could be confirming Judges for the whole month of October.

Campaigning, but a couple Sens. will have to come into town to consider the NDAA in 2 wks., & Judish nom hearings are likely still happening remotely, so there'll be plenty of confirmations to proceed straight to upon return in Nov.

Why?  We could be confirming Judges for the whole month of October.

Campaigning, but a couple Sens. will have to come into town to consider the NDAA in 2 wks., & Judish nom hearings are likely still happening remotely, so there'll be plenty of confirmations to proceed straight to upon return in Nov.

I am quite disappointed in Chuck Schumer. I was hoping for a couple more circuit court confirmations before the election. As it stands now, Biden just had his 25th circuit court judge confirmed. That leaves 12 awaiting further action: 5 have been approved by the committee and await floor votes, 2 require discharge votes, 2 are awaiting a committee vote, and 3 are awaiting a committee hearing. If the Senate falls, that's a tight lame duck session to get them all confirmed (not to mention how many district court nominees need votes, although they only require 2-hour cloture votes as opposed to 30).

I have to say I'm also at a loss as to how the 1st and 4th Circuits both have unfilled nominees when both states (NH and MD) have two Democratic Senators. I understand the unfilled vacancy on the 7th (IN), since the judge there died in mid-June. Gregg Costa's resignation makes the 5th Circuit even more conservative than it already was. If the White House couldn't work something out with Cornyn, they should've just did what they did with the Andre Mathis nomination.

There's a lot riding on the remaining nominees. The DC Circuit can be locked in for at least a generation, a liberal majority can be reestablished on the 2nd Circuit, the 3rd Circuit will go from a conservative majority to a tie, and the 10th Circuit can have its liberal majority locked in.

There is no excuse. I'm not sure who to blame, either the White House or Cardin and Van Hollen. I'm assuming the latter considering the South Carolina seat has a name (and there's no way the White House didn't consult with Graham on that nominee). The 4th Circuit was one of Obama's biggest judicial legacies, going from a staunch conservative majority to a 10-5 Democratic-appointed majority (Obama got six judges confirmed there).
