Judge T.S. Ellis III of U.S. District Court in Alexandria declined to issue a preliminary injunction to stop Republican Bob Thomas from being sworn in as a delegate next Wednesday, saying the plaintiffs had not shown they were likely to prevail.

“I think the officials in these precincts made a reasonable decision to rely on the data they had,” Ellis said.

While he acknowledged that the mistake was “a big deal” to the affected voters, “there are other big deals,” including “federal courts sticking their noses into state election procedure.”

Meh.... we'll steal it next time. This is perfect training for younger less experienced legislators and candidates who are not yet versed in the realities of American politics. GOP = done!

Well if you can stand by someone who rationalizes their decision with "the mistake is a big deal but there are other big deals too you know", then good on you. I mean, a line was crossed when you kept ferociously supporting a kiddy diddler when his crimes came to light so anything goes I guess.

This district court of Virginia has roughly a 2/3 majority of Republican appointees. If one was going to attempt to steal an election, they should choose a better venue. Alternatively, they could actually try to win the election straight up.

I’ve never understood how Krazen thinks Democrats exhausting legal remedies that are also available to Republicans is “stealing an election.” I mean, I get it, since he’s an uncritical hack, but seriously get some better material

I am pretty sure you are confused and have the wrong seat, pal. Mr. Thomas won this election by far more than a single alleged 'overvote', which was of course thoroughly litigated by the judges.

Thomas beat Cole by 73 votes in House District 28, which includes parts of Fredericksburg and Stafford County.

But why on earth would anyone trust someone like Simonds to actually uphold such a deal?

It's a near guarantee they'll win control of both the senate and house next year (or are the senate elections this year?)... all that's up for debate is the margins.

Do special elections for state house happen in Virginia?

They don't need to do better. They needed to over-perform in 2017 in part to knock off a bunch of incumbents, and now that they already cleared almost the entire GOP majority, it'll be easy to pick off a few extra seats in the HoD, especially considering that there are a number of Clinton/Northam districts to work with. The state Senate is even easier. But yes, there is no reason to think Democrats would just backslide right away. Presidents as unpopular as Trump have a tendency to keep the opposition party energized while they are in office.

Also consider that within the next couple months, we should know whether the HoD map is going to need to be redrawn to fix 11 or 12 districts, which should expand the map even more since Northam is not going to sign a fresh gerrymander for Republicans.

This whole debacle is a very strong reason for having non-partsan and impartial courts. also, a strong argument against letting STATE LEGISLATURES pick judges.
