Apparently Trump only realized his schedule was available to the public a couple of weeks before leaving office.

Quote
White House staff began distributing a bizarre statement claiming then-president Donald Trump was spending his days making “many calls” and having “many meetings” in lieu of releasing a detailed daily schedule after Mr Trump discovered the decades-old practice during the final weeks of his term in office, a former press aide to Mr Trump has said.

In testimony before the House January 6 select committee, former Deputy White House Press Secretary Judd Deere told the panel Mr Trump only realised that his staff was providing reporters and other interested parties with a copy of his public event schedule “beginning sometime around mid to late December” in 2020.

“This morning I had meetings with ministerial colleagues and others. In addition to my duties in this House, I shall have further such meetings later today.”

It seems like the reference to deprivation of rights is about 18 USC 242:

Quote
Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States … shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both.

There’s language in there about the deprivation being on account of race/color/alienage, but I feel like that must be modifying a different clause than the one I quoted (specifically a clause I left out about disparate treatment under the law) because I doubt they’d try to argue that January 6 or Stop the Steal were race-based in court. I don’t think that’s provable beyond a reasonable doubt.

Edit: DoJ website confirms my reading

If you lock him up, forget 1/6, it'll be 1776.

It’ll be better than 1776.

So how long will it take for the other co-conspirators to be indicted? And will they all share a cell?

This is a case where I think the death penalty should be on the table, at least to put some serious fear in him. His crimes are practically treason.

Social score -9.22

This is the .78.

This was two Trump appointees and an HW Bush appointee who concurred narrowly.

January 15 seems a little late, no? He would have known he wasn’t going to continue in or be restored to the presidency regardless of his views on the merits of his legal claims.

At the Appeals Court, Trump’s lawyers are currently, explicitly arguing that it would be perfectly legal for the president to assassinate a political rival.

Specifically they are arguing that he would be immune from prosecution unless he were impeached and convicted first. Even though Senate Republicans said that the reason they weren’t voting to convict him in 2021 (purportedly) was that he should be tried in court instead of being impeached and convicted!

Even Trump's attorney conceded that ST6 has a duty not to follow illegal orders. The Justice Department can't just arrest anyone Biden tells them too, including say all of Congress, even if he would hypothetically face no prosecution for it.

Well if he wouldn’t be able to face prosecution for it why can’t he order them to do it?
