We have a new batch of judicial nominees this week. Most importantly, it includes nominees for the 3rd and 4th Circuit Courts. That leaves just one circuit court vacancy without a nominee (a GWB appointee on the 6th Circuit from TN that announced taking senior status in August).

Actually, when I started making this post, I didn't notice that an Obama appointee on the 1st Circuit (for the Maine seat) has announced he'll be taking senior status. If Biden fills that seat (and gets his NH nominee confirmed), he'll have appointed 5/6 active judges on that court.

So long as Schumer keeps the confirmation train going (hopefully clearing the backlog of nominees that have been building on the Senate floor by the end of the year), I will certainly be happy. President Biden is exceeding my expectations and I hope he doesn't let up.

This is quite a sprint, but there's so little time left.

If I've followed correctly, the Senate session breaks on Thursday 15 December, and resumes on 22 January 2024 after a 5 week Xmas holidays?

This would leave exactly 10 working days for 19 oven-ready judges.

All indications are she would not have the votes. She is expected to do the job in an acting capacity for the remainder of the Biden administration.

This is quite a sprint, but there's so little time left.

If I've followed correctly, the Senate session breaks on Thursday 15 December, and resumes on 22 January 2024 after a 5 week Xmas holidays?

This would leave exactly 10 working days for 19 oven-ready judges.

I'd like to see another circuit judge (or, ideally, more) confirmed before the end of the year. I'm not sure if it'll happen, but it'd certainly make me happy. There are three currently awaiting final confirmation votes. Hopefully, in the meantime, Biden will send over nominees for the 1st and 6th Circuits. The 1st Circuit seat is for Maine, so there's room to build rapport with Susan Collins. The TN Senators are awful and I'd be surprised if Biden doesn't end up moving around them altogether. If all of those get confirmed, Biden would be at 45 confirmations for the circuit courts (not including whatever may open up between now and the end of this term). Before Trump (53), the time a President got over 40 circuit judgeships confirmed was Reagan's second term (50) and Carter (59) before that. (Of course, Carter and Reagan presided over significant expansions of the judiciary. In 1978, 35 circuit judgeships were added. From what I could find, I think they added 24 seats in 1984. That time period also included the creation of the 11th and Federal Circuits.)

I'm less concerned about district court judgeships, because they can be done quickly. Cloture is only 2 hours for those (versus 30 hours for circuit court nominees). A number of those are also red state deals, so there's incentive for some Republicans to get on board.
