Yeah even with a cooperative Senate, I don't think you could ever get judicial vacancies down to zero.

And by cooperative Senate, I mean one where they didn't play the games of the past 20 years or so, where a Senator doesn't like the president and keeps a seat open for the entire term. There have been judicial vacancies in Florida for Biden's entire term of office.

I think the goal should be getting circuit court vacancies down to zero. McConnell came damn close to doing that in 2020 and that was on top of ramming the Barrett nomination through the Senate. They even managed to fill her 7th Circuit seat within two months of her elevation. Only two circuit court vacancies were left open for Biden, a 1st Circuit seat that became open due to a death (late October) and a 7th Circuit seat where the judge took senior status (late November). Every circuit court opening should have a nominee by now (especially the 4th, 7th, and 10th).


Looks like Schumer's getting some of the more difficult nominations out of the way. Dale Ho has been waiting almost two years. His confirmation leaves only one judicial nominee left from 2021. It seems clear to me that Manchin wants to get his fill of No votes now. I think he'll definitely vote against Rikelman and possibly Bloomekatz whenever she comes up for a vote.

Looks like I was very wrong about the Rikelman nomination. The Democratic Caucus held together and it looks like Collins and Murkowski wanted to shore up their pro-choice credentials. (For those that don't know, Julie Rikelman represented the pro-choice side at SCOTUS in Dobbs.) Manchin actually specifically cited Roe as the main reason why he supports her nomination:

Biden is two and a half years into a four year term and there are still many vacancies. Either the number of Senate-confirmed positions needs to be reduced, or the length of the confirmation process needs to be shortened. Perhaps both.

Biden is two and a half years into a four year term and there are still many vacancies. Either the number of Senate-confirmed positions needs to be reduced, or the length of the confirmation process needs to be shortened. Perhaps both.

With many red state district court judgeships, the problem is blue slips. Some Republicans are working in good faith. Others are not. There's supposedly a possible deal for some district court nominations between the White House and Rubio for the Southern District of Florida, though it remains to be seen if it actually happens. The circuit court vacancies without nominees are really bothering me though. We're nearing 2.5 years with a vacancy on the 10th Circuit and over a year for the 4th and 7th. Cardin seems to be the issue with the 4th, which is inexcusable. (I understand the issue with the 1st with having to withdraw a nominee.) With the three currently pending nominees, Biden would reach 38 circuit court appointments. There are five circuit court judgeships without nominees at the moment. The goal needs to be all circuit court vacancies filled along with all blue state district court judgeships. Apart from that, it's a matter of negotiating with certain Republican Senators. Needless to say, as long as blue slips are around, states like Arkansas, Missouri, and Alabama are all a no-go.

I do have to say I'm surprised that Manchin voted against Rachel Bloomekatz after having voted for Rikelman. I really don't understand him. Bloomekatz is one of the circuit court nominees I'm really excited to see confirmed though. At 40, she'll definitely be high on the SCOTUS shortlist for a Democratic President.

Good news on the nominations front. Biden sent four new judicial nominees to the Senate. More importantly, two of them are circuit court nominees, one for the 7th (IN) and one for the 10th (KS). That leaves only three circuit court vacancies without nominees at the moment: 1st (NH), 3rd (NJ), and 4th (MD). There's an interesting story with the vacancy on the 7th, according to Wikipedia:

Gibbons, an appointee of former Republican President George W. Bush, on Friday confirmed reports that she plans to assume senior status upon the confirmation of her successor after serving 40 years as a member of the federal judiciary, including 21 years on the regional appeals court.

Currently, the 6th is 10R-6D in terms of active judges. Biden getting the opportunity to narrow that margin is no small deal. This is a second Tennessee seat opening up, so it'll be interesting to see who is eventually nominated. (The White House successfully steamrolled over Blackburn last time due to her intransigence.)
