13 Senators have been jurors in 3 out of the 4 Presidential impeachment trials:

It's really funny that large part of Trump's defense involves recognizing that the election was legitimate. He wanted to remain President, but now he is desperate to highlight that he is no longer President.

He's probably used to wearing a yarmulke and is making sure it doesn't fall off his head (although it's obviously not there atm).

Schoen would be right maybe about the Bill Of Attainder thing if the Senate had the ability to convict Trump of a crime that became a crime only after it had been committed. Another little problem is that his reasoning would apply equally to a sitting President. And that would mean the whole impeachment article would be a dead letter. Trouble here, trouble there, trouble, trouble everywhere. Well, the impeachment article is meant to carve out an exception to the Bill of Attainder prohibition Schoen sort of says maybe as he quickly and poorly reads something that someone else wrote who needs another day job, because the prose sucks, without any textual support. I guess he is not a textualist or an originalist, which is why he disagrees with all the Federalist Society scholars. Sad!

It is, yes, in lieu of a kippah. Some of us - more Orthodox sects particularly - are strict about head covering when eating, drinking, or saying a silent prayer. Kapo Schoen is devout for a mob lawyer.

Does one's own hand count as a kippah? For some reason I had thought that it needed to be someone else's hand so I figured it must be out of habit

This argument on constitutionality of convicting a former holder of public office is such a clear cut, no brainer, slam dunk, open and shut matter, I can't imagine what any defense argument could be other than "muh fraud...muh witch hunt..." Absolutely insane this is what the Republicans are going to use to justify their votes.

Even when his defenders argue against it they keep talking about being (supposedly) impeached after leaving office, bringing up impeaching past presidents, etc. So dishonest.

Why surprise? This is the perfect get off the hook defense for Republicans to acquit Trump. They can avoid having to defend Trumps actions on January 6th they must justify to all their states voters, while still being able to cast a vote getting Trump off " unconstitutional / due process grounds" rather than face a trumpist cult primary challenge.

An ultimate solution for the 90% spineless Republican Party.

There has not been one word stated to counteract the charge that Trump incited a riot.

Zero surprise. They're taking their one feasible - - note I didn't say compelling - - argument and running with it. That's actually a good trial strategy. Not that Bruce Castor isn't screwing the pooch in executing it.
