Not only should Democrats pack the court, but they should also impeach, Roberts, Thomas, Alito, Gorsuch and Kavaunaugh. That 15-0 Progressive Court needs to be a campaign platform promise.

This is insanity! Do you not think Republicans would try to impeach Breyer, Kagan, and Sotomayor, if such a course of action as you propose were pursued? It would be an absolutely foolish move, and would truly demonstrate that there is no longer a balance of power between the branches. Many of the things I've read today on this forum from Atlas Democrats are deeply disturbing to me, and a reaction that is unwarranted, with proposals that will be consequential and will backfire on your cause.

Then what do you suggest we do? Just let Republicans have this one?

They could have let Obama fill Scalia's seat and we would not raise hell about Trump filling Ginsberg's. Or since they changed the rules and fill Scalia's seat, they should let whoever wins in November fill Ginsberg's. But if they want to play hardball and fill both, we shouldn't and can't feel bad about playing hardball back. We didn't want to go there, but what choice do we have now?


Once again, Merrick Garland would not have been approved by the Senate. Obama literally could not fill the seat. That is the ginormous difference that allows the Republicans to do this.


How can you say this with such certitude?

I hate the idea of court packing. I really do. It sets a dangerous precedent and I don't want to frame it so that the GOP can come back in 8-12 years and add 5 SCOTUS judges, never mind what they'd do to the circuit courts. That said, I'm not just going to roll over and take the Republican abuse. It has to be framed a proportionate response to the norms violations the Republicans committed so they know if they try this sh!t again, this is how we respond (and vice-versa.) The Republicans stole two seats (Garland and RBG). Adding two seats is a reasonable response to get those two and no more back.

Republicans stole one seat (Scalia->Garland) and one Presidency. The aftermath resulting is three stolen seats when you consider Kennedy and Ginsburg with the presidency stolen utilizing the vacant Scalia seat.

Everyone needs to calm down. Biden is handling this right by not going crazy. Nothing has happened yet. One old woman has died, and that is it.

The Democrats and Trump just need to make a deal.

If Trump can make a deal with Kim Jong Un, surely he can make a deal with Chuck Schumer.

The Democrats will pass Trump's preferred COVID-19 deal, lower prescription drug prices for seniors, fund the wall, and repeal DACA legislatively, meanwhile Trump will promise to nominate a judge that both sides can agree on for the SCOTUS seat. This will de-politicize everything, and save the impartial judiciary, and make John Roberts very happy, and be good for the republic, our institutions, our 150 year judicial history, and everything. They all just need the will to do it.

Right, so it's not happening then.

I do agree, there should be a compromise of sorts here, but Republicans are not going to give it up. Not unless a tiny handful break from McConnell and say no.

I just hope the CR passes before both sides dig into their trenches. The last thing we need is a government shutdown with everything else going on.

No one in DC ever wants a shutdown (I was there for the last one) but if any time was appropriate, it would certainly be now.
