It's kind of funny that the republican senate leadership is willing to go nuclear to confirm a guy that essentially said he might vote to uphold Roe vs. Wade. That is supposed to be the #1 court case republicans want to overturn, and yet the guy they're about to confirm is someone who at times in his hearing seemed close to endorsing the verdict as is.

That's a misunderstanding of what he said.  He said it was a precedent, and so is due the respect of precedent.  But precedents can be overturned.

Absolutely - Even if Scalia was there, he would say he respects the precedent. There is considerable chance that Gorsuch may vote to over-turn Roe vs Wade but is it really possible. I can't see even Roberts going against Roe v Wade (Kennedy will be with the 4 Liberal judges). Full over-turn is very hard, maybe they will put some restrictions - Will even Alito vote against Roe vs Wade full overturn?

While Rode vs Wade looks very hard, gay marriage isn't. It was 5-4 right? If Kennedy goes & Trump appoints a conservative judge or it something bad happens to 84 year old RBG, then surely it is possible that gay marriage is over-turned. But then Trump is privately possibly for gay marriage - So would he appoint when he is in the company of Pence, Cruz & crazy Republicans?

There will be an open war for the next Supreme Court seat !

I think it is the opposite.  I am resigned to the fact that Obergefell is going nowhere anytime soon, as much as I believe in marriage being between a man and a woman, but, I am optimistic about the potential to overturn Roe v. Wade, perhaps even within 3-5 years.

as if clare's decision on this matter would change even 1 vote.

if she is gone in 2018 then she would have been gone anyway.

and after 8 years of obama, nuking the filibuster isn't at all scary for me...on the contrary. republicans should be much more afraid of it, since democrats always have been the nice party and too timid.

Given the fact that the Dems once obstructed and voted down a SCOTUS nominee and the GOP always accepted liberal choices, I highly doubt that ;-)
What delusional world do you rwers live in that you are under the impression you guys always cave to dems? Seriously Obama was historically obstructed since 2010 to the point where Trump has hundreds of federal court seats to fill along with a SC seat that has been vacant for a year but you guys think we always get our way?

He's saying that every Democratic appointee to SCOTUS winds up a reliable liberal, but we have been burned on Souter, Kennedy, O'Connor, etc.

Let's now put 10 20-something year-old judges on the Court who will be willing to not only overturn Roe v. Wade, but also say that all first-degree murder laws apply to the killing of babies nationwide.  Ending abortion is more important than our system of government itself.  I'm serious!

Sorry!  Your understanding of the Court is about as good as your understanding of chicken eggs.

Nothing says there has to be nine.  If we appoint ten more right now, those ten can be so conservative that they can overrule the other nine (Clarence Thomas would look like RBG next to these hypothetical ten).

With all due respect, if you think nuking the judicial filibuster had anything to do with Estrada, you're crazy.

Let's hope there will be another retirement/vacancy or two, so we can make more forward progress.

It has always amused me how so many Republicans think their party leadership actually wants to see abortion banned.  Weakening decisions like Roe vs. Wade and Planned Parenthood vs. Casey?  Sure.  However, they're just using you guys [pro-lifers].  They'd never actually ban abortion because of the huge political backlash that would occur across the country (especially in wealthy suburbs and exurbs and yes, that includes the arch-conservative ones).  Even without Kennedy or without Ginsberg, if there was a real chance of the Supreme Court doing a complete 180 on abortion, Roberts would switch.  This fight was decided a long time ago.  

You're right that Roberts (and Gorsuch) can't be fully trusted to actually overturn Roe, but to pretend the republican party doesn't want to ban abortion is silly. Remember the attempts to pass Personhood? Remember that OH would have a heartbeat ban, if it didn't have to be vetoed for the sake of strategy? (no sense starting a roe challenge until there's a chance to win at SCOTUS) I know you guys tell yourself lies about republicans so you don't have to think about your abortion not being there for you, but that doesn't change the fact that republicans want to make abortion illegal.

Oh, abortion will always be an option for people.  Technology is a beautiful thing.

I know this would be politically unpopular, but, once abortion is illegal, I would support a travel ban to any locations where elective abortion is legal to stop any Americans from being aborted and put pressure on those governments to ban it too.
