I posted this on the other thread before I realized the discussion had moved and gotten it's own thread here, but on what grounds is trump going to try to get this case moved from state court to federal court and how likely do we think it is that he will succeed? What is at stake besides trump being able to pardon himself should he win the election? Would the jury no longer be drawn exclusively from Fulton County?

There probably isn't any, the indictments only involve Georgia law. One could argue that there's an overlap with Jack Smith's indictments even if he didn't indict specifically for this, but even that wouldn't be grounds to move the case as the Supreme Court has made it clear that separate state and federal charges are not a double jeopardy violation (Gamble v. United States (2019), 7-2 decision, Gorsuch is the only dissenter still on the court [the other was the late RBG.])

I'd give my right nut to be seated at that trial when these posts are read, and when the prosecution notes that despite all the bluster and bloviating, trump produced exactly zero evidence of voter fraud when given the opportunity to do so in the discovery process, nor did he show up when invited to testify and provide all of this supposed evidence that totally exists in real life.

Only if a murder is involved. If not then the law is unconstitutional because the Supreme Court has ruled that no crimes other than murder may receive the death penalty.

I think these indicted co-conspirators show why Bill Barr actually finally stood up to Trump and even claimed there was no fraud, as loathsome as Barr is he's apparently not an idiot and realized that Trump had no chance of overturning the results and thus that if he went along with Trump's claims and made baseless claims of fraud then he too could end up being indicted afterwards along with the rest of these clowns. He's probably breathing a sigh of relief right now.

This is probably the most devastating indictment yet. Jack Smith's DC one probably has a better chance of conviction especially because there might be some attempted interference from the state in this one, but damn this is so thorough.

Lindsey Graham being indicted would be hilarious considering that he was both humiliated by Trump in a near Jeb-like manner and reportedly was demanding that the Capitol Police start spraying gunfire and massacre rioters during January 6. Imagine being so humiliated by such a guy, so terrified of his supporters he essentially sicced on you you start screaming about that...and still face criminal charges for backing him.

I think the biggest issue is if Trump does hold rallies the odds of him not saying something that would normally get him held in contempt of court are near zero. You can tell Trump over and over and over again that he absolutely needs to not bad mouth the prosecutors and judge, but that doesn't mean he's capable of not doing it.

Yes, Trump could just take the Fifth and decline, but that's not his style, he probably would jump at the opportunity for more limelight. Except Trump would also have no qualms blatantly perjuring himself. He could be tried again for perjury after the fact, but is more trials and prolonging it what is wanted or ideal? For that reason I think it's probably best to just not ask him to testify at all.

The defense doing so would be downright idiotic from their standpoint, but since Trump probably doesn't care and if he ordered his lawyers to call him to the stand, that very well might end up happening.

They can't put him on the stand just to make the jury see him take the 5th. When it's the defense's turn the judge will ask him (with the jury out) if he wants to testify and remind him it's his right to testify or not.

My point is more that he probably wouldn't take the Fifth. But that wouldn't necessarily work in the prosecution's favor if he just blatantly perjures himself which he's perfectly willing to do.

I mean it's not going to really have an impact on the likelihood of a conviction, but the idea behind getting it moved to federal court is so that Trump (or a future Republican POTUS) can pardon him.

You're right, Kemp isn't pardoning Trump.  But the reason is simple: in Georgia, the governor has no power to pardon.  It was taken away in a state constitutional amendment in 1943 following the indictment of Gov. E. D. Rivers for selling pardons, among other corruption charges.

Quite. It requires a 2/3 majority in both houses to pass and then being passed by the voters. So obviously even the first isn't possible as the Republicans don't have that majority.

Yes, pending trial, although this is why businesses like Scott Hall's exist, they'll put up the money but require 10% of it as a fee. Which is still a lot of money to most people. Of course most bails aren't set this high, only for very serious charges and/or people who have a lot of money and can afford it, in this case both apply.
