in New York State, if you are over 21, DUI is a .05 BAC and DWI is .08.  but if you are under 21, DUI is .02 and DWI is .05.

my question: should age be considered in the making of blood-alcohol laws?

I've always found it to be incredibly stupid and unfair. It's 0.02 in PA for DUI which means I can be arrested if I have a beer and drive somewhere.

In NJ, until your 21 you cannot have any detectable amount of alcohol in your system.  Now that's rough, I drank a bottle of beer the other day and then realized that technically I could have gotten a DUI

Anyway, I don't think they should vary by age, but I think the legal limit should be under .1, drinking is great, drunk driving is not

Do they charge you with DUI, MIP or intoxicated minor?

In Driver's Ed they always told us DUI, that might have been to scare us but I doubt it.  I can't find it online, but I'll try and find my Driver's Ed book later.  I'm 90% sure its a DUI though

I think it should either not matter at all, or be like we have here:  Over 21 is .08 (we were the last state to change from .10 to .08.. weird) and not-a-drop law for those under 21.

The consequences for blowing a .02 while driving under the age of 21 is still less serious than a 23 year old driving with a .15

I can't wait until self-driving cars make laws like DUI/DWI moot.

I can only imagine the hilarity that would surely ensure from such an invention.  If you think drunk dialing is bad, just wait until your idiot ex or stupid frat boy buddy shows up at your house after drunk dialing your address into their self-driving car.

Hopefully, by 2020, cars will have alcohol sensors installed with them that will disable the car, if it detects alcohol from the driver.

They already have versions of that, and studies have shown that they often end up causing more accidents.

The thing I've never understood with those breath in to start the car things is if you can bypass that by having a passenger blow

I guess they figure that if you have a non-drunk passenger, the drunk guy isn't likely to be the one driving.

Seriously, any sober person that starts up a drunk's car for him deserves to be in an accident.  How stupid can you get.  If your friend is too drunk to get past the breathalyzer then you'd have to be a complete moron to do it for them and then let them drive you home.  Even if you aren't going in their car you should just offer them a ride home.

An extra $100 or so? It'd be worth in terms of reduced insurance rates anyway.

lol it would cost more than $100.  a car dealer will charge you $100 just to get an ashtray in your car.

not to mention, it has to be re-calibrated every few months.

i dont know about you brtd, im not too hip to the idea that my car wont work if i happen to have a little alcohol in my system in the morning after a long night of festivities.

Another interesting problem with BAC laws arises with people with a high tolerance to alcohol, especially chronic alcoholics.  Drinking three beers in an hour can have radically different effects depending on personal drinking history, and obviously the degree of impairment will vary from person to person.

I doubt that would happen. I can't imagine a self-driving car flawless enough to never have to revert to a manual mode, unless it was fixed to a track or something. If anything, I could see it becoming even more of a problem on the occasion that the drunk driver accidentally switches between operating modes, not as accustomed to driving already.
