(a) has as its objective the amelioration of conditions of disadvantaged individuals or groups who are disadvantaged because of Indigenous identity, race, colour, ancestry, place of origin, physical or mental disability, sex, sexual orientation, or gender identity or expression, and

(b) achieves or is reasonably likely to achieve that objective.

(2) [Repealed 2002-62-23.]

(3) On application by any person, with or without notice to any other person, the commissioner may approve any program or activity that has as its objective the amelioration of conditions of disadvantaged individuals or groups.

(4) Any program or activity approved under subsection (3) is not in contravention of this Code.

Maybe their music department as a whole (or professors university-wide as a whole) have a shortage of black people, and they have a diversity quota that will be unfulfilled unless they hire a black professor?

I'm trying to find some sort of logic in why a music theory and music tech teacher would need to be black to qualify for the job. They were probably right at their lower limit of black / non-white professors, and then a non-white (or black) professor left, requiring the replacement to also be black or non-white in order to stay compliant.

We could comment on the pros and cons of diversity quotas, but that's really a whole other separate topic of conversation.

Are those legal in Canada? They definitely aren't in the US per Board of Regents of University of California v. Bakke.
