Hate Has No Home Here Act

1. Any abortion performed due to the race, ethnicity, sex, sexual orientation, or gender identity of the unborn baby is against the public policy of Atlasia and is hereby prohibited. It shall be unlawful for any person, entity, or organization to perform or offer a referral for any abortion prohibited by this act.

2. A violation of this act shall be a felony punishable by imprisonment for no less than one (1) and no more than ten (10) years and a fine of $25,000.00.

3. This act shall take effect immediately.

A version of this bill failed at referendum due to a provision that closed clinics unless they adhered to specific limits for providing abortions for certain races. While I was a supporter of the bill in that form, I have come to realize it opens the door to a defacto total ban in certain areas at certain times. In that spirit, I whipped a swing vote against it in the final hours and was ultimately glad it failed. This version of the bill eliminates that clause, providing a clean ban on abortion on race and sex-selective abortions without infringing on abortions done for other reasons. I urge swift passage.

I am not seeking to govern the exact form in which a clinic or hospital would comply with this law, although I do not see why it would be difficult to have a patient sign a legal document indicating they are not requesting the abortion based on race or sex. Ultimately, of course, any alleged felony would need to be proven beyond a reasonable doubt in a court of law. If the provider reasonably believed the abortion was being done for reasons not based on race or sex, they would presumably lack the mens rea to be found guilty of a crime.

It's for these reasons that I do not support this. The only guaranteed outcome of this legislation, in the best case scenario, would be more unncecessary processing for healthcare facilities and extra work for patients. At worst, this could result in a mountain of frivolous lawsuits aimed at patients seeking abortions and/or healthcare clinics on unprovable charges of racism or sexism.
