As explained above by TPH, the language you cited was partially repealed in 2022. This adds it back with stronger language. It's unfortunate we were blocked from making the changes more cleanly but the original is strong.

This bill adds a Section 5(3). It's not "adding back 5(2) with stronger language."

I don't know if the point was to intentionally preserve the lacuna – again, why pass this bill if it has a gaping hole in it when you can very easily fix it by introducing another amendment? I didn't make it to the amendment vote in time, you probably could've gotten me to vote for it.

Perhaps we would succeed on another vote, but perhaps not since both sides had attendance issues on that vote. With or without the gap, what is happening here is clear enough and I feel it's time to have a clear vote on the bill.

It's clear enough that bills are knowingly being rushed to votes despite issues acknowledged with them.
