An Act to Promote Education at Universities

Section 1: Title and Intent
1. This act shall be known as the "Stopping Excessive Compensation Act".
2. The intent of this act is to limit salaries for people who coach an athletic team and people who direct an athletic department at publicly-funded colleges and universities.

Section 2: Limit on Salaries
1. No accredited institution of higher learning that receives public funds may pay a director, coach, or member of an athletic department or a sports team an annual total compensation package greater than 150% of the annual total compensation package of the highest paid educational staff member at the institution.
2. Colleges may not use the fact that they treat sports practice as a "class" and/or confer credit(s) for participation and/or performance in practices and/or competitions as a valid legal defense to pay someone a higher salary than would otherwise be authorized under this law.
3. Colleges may not use the fact that they personally consider people who coach or direct athletics to be educational staff members, nor the fact that they use alternative job titles for what would traditionally be called a "coach" or "athletic director", as a valid legal defense to pay someone a higher salary than would otherwise be authorized under this law.

Section 3: Sanctions
1. Any accredited institution of higher learning that receives public funds that is found to violate this Act will immediate waive any further public funding for two fiscal years.

Section 4: Enactment
1. This Act shall take effect January 1, 2024.

Thank you, Mr. President. I know college sports are a national pastime, from the Rose Bowl to March Madness. However, the salaries for coaches and athletic directors are stupidly high - often at the expense of educational staff. The purpose of college is to learn. By capping salaries for athletic staff, we can steer higher education back towards education as their primary purpose. This bill also acknowledges the positive aspects of college sports, hence why the maximum athletic salary is set at 150% of the highest educational staff salary.

All this will do is get the universities to rename the positions. Like Cal State already classifies coaches, presidents, and any faculty as administrators. Also athletic directors make about the same as university presidents and most coaches aren't paid any higher than a lot of professors.

You're missing the other point they'll just reclassify the job title. It's an easy workaround. Also, I believe college sports practice is technically a class. At least it was at my school.

Would changing the language to “person who coaches an athletic team” and “person who directs an athletic department” satisfy your concerns? I think the initial language is clear in the common understanding, but could see the hypothetical you’ve posed. This new language shifts the focus from the job title to the job duties.
