Fulton County prosecutors ask for emergency seal of evidence after video leak in election subversion case

A leak of discovery materials in the Georgia election subversion case against former President Donald Trump and his co-defendants prompted the Fulton County district attorney’s office Tuesday to file an emergency motion for a protective order in an attempt to prevent other material from becoming public.

Portions of proffer videos – the legal term for videotaped conversations some of Trump’s co-defendants had with prosecutors – were leaked to several news outlets on Monday. ABC News and The Washington Post reported on the videos, including on-camera statements from former pro-Trump attorneys Jenna Ellis, Sidney Powell and Kenneth Chesebro as well as Atlanta-based bail bondsman Scott Hall.

The four of them were required to give the proffers to prosecutors as part of the plea deals they cut with the DA’s office in the sprawling racketeering case brought against them.

Georgia Prosecutor Sees Trump Case Stretching Into 2025
As the prosecutor, Fani T. Willis, discussed the case at a conference, her office sought an emergency protective order to prevent more leaks of discovery materials.

Fani T. Willis, the Atlanta district attorney leading an election interference case against former President Donald J. Trump and 14 of his allies, said on Tuesday that a trial would very likely “not conclude until the winter or the very early part of 2025.”

She also defended the scope of the racketeering indictment she brought in August, noting that she had prosecuted far larger racketeering cases in her career. Defendants in such cases “got involved in the criminal enterprise,” she said. “They deserve to be charged. In fact, they earned it.”

Ms. Willis’s office charged Mr. Trump and 18 other defendants with participating in a criminal enterprise aimed at changing the outcome of the 2020 presidential election. Four of the defendants have already taken plea deals, agreeing to cooperate with prosecutors.

The timing of a trial for the other defendants is not clear, since a trial date has not been set. But there is growing speculation that the district attorney will seek a summer start.

Since May is the current Florida date, it's possible Georgia moves up a few months once that is moved. I think NY is scheduled for late March too.
