Whereas Article III, Section 6 of the Southern Constitution provides that:

Quote
In the event that the President of The South, Vice President of the South, or any other executive official, commits an action or an instance of negligence that is deemed injurious to the public welfare or morals or to the interests of the Region and that is legally prohibited, House of Burgesses shall begin impeachment proceedings upon the sponsoring of one or more articles of impeachment by a member of the legislature and the seconding of such articles by another member. Should three-fourths of the House of Burgesses vote to convict on one or more articles, the executive officer in question shall immediately forfeit their office and be banned from running for any Southern office for two years.

Whereas LouisvilleThunder formerly served as Secretary of State and formerly served as Governor, I sponsor the following articles of impeachment

ARTICLE I: Negligence as Secretary of State

Article III, Section 2 of the Southern Constitution provides that:

Quote
the appropriate election administrator will open the voting booth at 12:00:00am EDT [on Friday]

LouisvilleThunder as Secretary of State, was the appropriate election administrator assigned this constitutionally mandated task, but had repeatedly failed to open voting booths on time. I had to be the one to post polling booths for four of the past five elections. LouisvilleThunder had accordingly neglected his duties as Secretary of State to a degree that was injurious to the public welfare of the South

ARTICLE II: Denial of Constitutional Rights to Accused Persons as Governor

On January 24, 2022, then Governor LouisvilleThunder posted the following executive order:

Quote
Executive Order #11
The names listed below are to be known as Enemies of the South for engaging in seditious activities against the lawful government led by Governor LouisvilleThunder of the South

Donerail
BOOBS
CalamityBlue
Western Democrat
Ishan
0regon Sxmp D0g
Scott
Harry S Truman
Dwarven Dragon
TheShadowyAbyss
Utah Neolib
Crane
S019
Solid4096

This "proscription list" which included a Southern citizen, Donerail, purported to criminalize individuals for seditious activities without a free and fair trial.

Article II, Section 4 of the Southern Bill of Rights provides that:

Quote
In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and locale wherein the crime shall have been committed, as determined by law and allowing for changes of venue when an impartial jury cannot be empaneled, and to be informed of the nature and cause of the accusation and be provided with a copy thereof; to a writ of habeas corpus when appropriate; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, to have the assistance of counsel for his defense, to present evidence of his innocence, offer jury instructions, exclude evidence obtained in violation of this Bill of Rights, and raise alternative arguments without prejudice.

Then-Governor LouisvilleThunder accordingly denied accused persons their constitutional rights in a flagrant manner that was injurious to the public welfare and morals the Region.

Introducing these articles of impeachment. Although LT just resigned as Southern Secretary of State today, he should still be held to account for his past actions as an executive official in this region. Asking for a second from another delegate.

The Southern Constitution does not bar ex post impeachment.

-----

Seeing a second on the motion for impeachment, I move that LouisvilleThunder, or any advocates he may have, be given 24 hours to present evidence on his behalf. After which point, the assembled members of the House of Burgesses will conduct a trial on the aforementioned charges.

The impeachment started while you were in office, LT isn't in office when this started.

Seeing no evidence presented that purports to establish the innocent of the accused, and with the sponsor not having any more evidence to present, we will now vote on these articles of impeachment. If a member objects to this vote, the vote will be voided, and debate will resume.

LT's resignation as Secretary of State was not sincere since he just opened up an election thread

Although receiving the requisite three votes, because this impeachment vote was never properly closed, and House of Burgesses membership has changed in the interim - I believe this impeachment would be legally defective if I were to try to close the vote now, so I am withdrawing these articles.
