Trump paying close attention to potential jurors, craning his neck to get a good look


Donald Trump appears to be paying close attention to prospective jurors seated in the jury box as they answer their questionnaires for the court.

At one point during their responses, Trump shifted his chair to get a better look at the potential panelists. He has his head tilted back and is leaning in his chair as he cranes his neck to get a closer look while they speak.

In my over 20 years practicing criminal law, I have never observed a defendant refuse to stand and face the jury.

Any competent lawyer would tell their client that his fate is in the jury's hands and they will watch everything he does.

Trump's disrespect for the jury is unwise.

The only thing that's more stupid than freaking out over Trump not standing is defending it by saying he's been turning his neck.

Who's freaking out? It's appropriate legal commentary for a criminal trial to note that unusual disrespect for the jury by the defendant on trial is typically disincentivized from the standpoint of being a criminal defendant whose fate is ultimately the jury's to decide.

I almost wonder if Trump actually believes that legal myth (similar to the one that undercover cops aren't allowed to lie to you), that you can be a complete ass to the judge and jury and then get the trial nullified on the grounds they were unfairly biased against you.

I'm not a lawyer but isn't the speech that endangers other people's safety and lives unprotected by the first amendment?
I mean if it isn't then you can reveal the whereabouts of a person in witness protection and suffer no consequences.

Prior restraint of speech posing a serious & imminent threat to a protected competing interest like juror safety can be 1A-kosher but it's obviously an inherently very fine line to tread when involving the press.
