S.T.D. ACT

1. This law shall be known as the Stop Transmissible Diseases Act or the S.T.D. Act.

2. It shall be a misdemeanor punishable by imprisonment for no more than 90 days and a fine of no more than $5,000.00 for any person to litter, discard, or dispose of a used syringe, hypodermic needle, condom, tampon, or sanitary pad on a public road, street, sidewalk, alley, or other right-of-way, in a public park, playground, library, school, or other government office or facility, into a stream, river, or watercourse, or on any private property not owned by such person.

3. If a person is convicted of a violation of this act on three (3) or more occasions within a five (5) year period, such conviction shall be punishable by imprisonment for no less than 60 days and no more than one (1) year and a fine of no less than $5,000.00 and no more than $10,000.00.

4. For purposes of this act, discarding or disposing of a used syringe, hypodermic needle, condom, tampon, or sanitary pad in a trashcan or waste bin shall not be considered a violation of this act.

5. This act shall take effect January 1, 2023.
