1. No corporation, LLC, or business enterprise that is required under Lincoln law to file and pay a tax on net business income may deduct the cost of luxury fringe benefits provided to employees as a business expense for purposes of calculating net income.

2. For purposes of this act, luxury fringe benefits shall mean any complimentary tangible benefit exceeding $10 per employee per year that an employer provides to an employee that is not necessary for the employee to perform his or her job. Luxury fringe benefits includes complimentary towels, alcohol, mixed beverages, meal services, promotional items, tickets to sporting or other entertainment events, entertainment performances, limousine services, private use motor vehicles, vessels, or aircrafts, cry closets, and crayons and coloring books.

3. This act shall take effect January 1, 2023.

This bill cracks down on companies avoiding taxes by listing elective luxury expenses and benefits as necessary to operate a business. Handing out alcoholic drinks, sports tickets, and coloring books to employees does not further their job, support the employee's family, or provide anything meaningful to the company. It's simply a waste of resources that our government should not endorse.

Lincoln has of course already passed important corporate tax relief, including a reduction in the top corporate tax rate from 36% to 25% and a reduction in the number of corporate tax brackets from 12 to 6. Corporations also benefit from the elimination of taxes we once had on Gas, Tourism, and Wealth. Lincoln is a prime place to operate a business and that should continue. But enabling the wokeness-derived adult daycare culture is not a worthy cause.

The amendment cuts out so-called 'cry closets,' which are beneficial to those with conditions like PTSD and depression and are an one-time addition to a workplace instead of a repeated benefit that can be taken home, from the list of 'luxury fringe benfits.'
