I say that if the local courts fail to resolve this election in a fair manner (ie. call for a new election with a new ballot that is not retarded), then it is up to the new Democratic Congress to either say that no one won and not allow Buchanan to take his seat in the new Congress, or - preferrably - call for a new election.

Agree with a new election. The situation is too suspicious to let Buchanan take a seat in Congress but not quite suspicious enough to just give Jennings the seat, either.
