So what happens if the outer space treaty either is never adopted by anyone or the prominent nations on the floor of the UN respond to the one suggesting it by saying "TITS OR GTFO. LOL"? Consider that without the outer space teaty nations would be able to lay claims in space/do serious investments in space along with militarizing in Space. Also consider that without the bans on nuclear explosions in space that stuff like the Orion nuclear pulse drive gets used.

The reason there is no Orion is that in order to launch the damned thing you have set off way too many A-bombs inside the atmosphere where you'd make a ton of fallout.  The EMP effects of the Orion would also be a female dog.  I certainly would not like to see an Orion used anywhere below the exosphere.  Once you restrict it to that, you're left with a system that is only practical for passengers and express cargo.  Regular cargo would be better sent by chemical rockets or ion drives as it would be slower but a lot cheaper to do so.  As for valuable space rocks, Luna is not one, the earth crossing asteroids are too small, and the main belt is too far away.  Our first real space colony should be on Mars and it's from there that we should expand to the main belt.  However, like most colonial ventures, a Mars colony would not make economic sense for a colonizing company.

I see us expanding in stages. First orbit, then the moon, then the inner system, then the belt, then the jovian moons then the stars.
