Maybe, be you can 100% sure that Biden won't announce a pick without preclearing it with Manch, so once we know who it is, everything is theater up to the confirmation vote.

He might vote "Nay" to spite Biden for comparing him to George Wallace and Jefferson Davis

If RS take control and there is a vacancy, Biden will Recess Appoint  if Manchin says no, Biden isn't gonna make the same mistake as Obama did, Prez can Recess Appoint, and Rs will be in Recess to campaign in October for November election

Usually retirements are at the end of the term, so doubtful.

I feel like, to the extent that Manchin wants to win re-election, that sort of stuff probably helps him, and he wouldn't actually change how he plans to vote based on (political, maybe not personal) insults from Biden. I don't know if Manchin is actually planning on winning or even running for re-election, though.

I don't think he will lie and promise to vote yes and then double cross him just to embarrass Biden, the nominee, and the party. Any spiteful action will be telegraphed and forwarned.

Not so Kennedy retired in 2018 right before the Midterms that helped Blackburn defeat Bredeson due to his flip flop on Kavanaugh

Do RS know we have way more targets in the Senate than they do, and Mark Kelly, CCM and Hassan aren't losing in 3.0 Unemployment

And Mandel, McCrory are so weak and Rubio and DeSantis are only leading by 3

A blue wave happens we Ds since we live in big states get 80 votes and Rs live in Small states dont get 74 M in 2020 they get 60 or 65 M

I have always donated to Tim Ryan he is our DC Statehood candidate because we get to 52 seats without GA which is heading to a Runoff and 52 votes ensures DC Statehood and Crt packing, and BlKs like him like Strickland and Brown and don't know who Mandel really is and along with Muslims and females can make Ryan a winner

The coping begins. Hate to break it to you nerds but judges are the single best aspect of Manchin. He hasn't sunk a single judicial nominee thus far, and these judges haven't exactly been centrists. Especially after the stunt McConnell pulled with ACB, Manchin will vote for whoever Biden nominates, same with Sinema. You're just going to have to console yourself with your untouched 6-3 majority.

Maybe its Sotomayor.  She has become increasingly mentally unhinged thanks to Covid and now refuses to be in the same room as unmasked people, despite presumably being fully vaccinated.  Since she's too afraid to attend in person work-related meetings, seems possible she's going to retire soon realizing that Covid is never going away.

She literally has a chronic auto-immune disorder and at much higher risk for a serious covid infenction ffs

Yes.

If this is accurate, it's extremely likely to be Sotomayor given the recent news.

Still think Breyer retires around Independence Day either way.

He "literally" is not. Gorsuch (like every other justice) is fully vaccinated and boosted, and is currently asymptomatic. If Sotomayor is still worried about transmission, she always has the option of wearing an N95 mask — which, as we've discussed extensively over the last few weeks, protects the wearer even if other people are not wearing masks. The likelihood of transmission from a boosted, asymptomatic person to a boosted, N95-wearing person is basically nil. This is theater, nothing more.

Kamala Harris would honestly be a terrific pick.  She's a very bright and qualified person who's on the right side of almost every issue, but seems to have horrible political instincts and no real electoral constituency.  She's a little only the old side, but just barely.  And this would allow Biden to nominate a new VP with actual appeal to Latinos.

Dems would immediately lose their senate majority.  It requires a majority of both chambers to select a new VP after the vacancy, and there would be no one to break the tie in the senate.  Republicans would have a say in who the new VP is and they could even hold the VP seat open until 2025 if they wanted to.

If politely asking your coworkers to wear a mask while you’re all in a meeting together is “theater,” then what do you call being the one jerk in the office who refuses to wear one?

"Politely" is nowhere to be found in the tweet, thats your inference.  I'd just call the refusal simple common sense.  No need to cover up your face simply to satisfy someone elses neurosis when it has literally no clinical benefit.  Sonia Sotomayor is going to be around people "literally putting her life in danger" until she goes to the grave if this is the standard everyone is now held to.

Okay, but Gorsuch is one of Sotomayor's eight closest colleagues, not some random guy she runs into now and then. It's selfish and unkind to be the one person in a hypochondriac's life who refuses to help them feel more at-ease, even though it's not quasi-homicidal in the way that leecannon is saying it is. Gorsuch is the most intellectually serious of the current ultraconservative justices and one of maybe three or four current justices tops who engages in actual thought at all, but he's struck me as a royal pain in the ass on a personal level for a while now and my hearing this doesn't do much to change that impression.

If somebody close to me had this paranoia and fear, I wouldn't validate it or encourage it.  I certainly wouldn't cover my face just to satisfy them.  This would have been a no-brainer pre-Covid, and in fact it should be now but we have a traumatized population.  The correct answer is for her to seek help, not try and dictate what other people wear.

Interestingly enough, there are some (including a former clerk of Gorsuch's, apparently), who are claiming that Roberts did not make this request to the Justices, that they masked up on their own volition, and that Sotomayor decided to go remote through her own volition. In other words, what was reported by Totenberg and NPR is hearsay. I'm inclined to believe the initial reports, given that Totenberg has been reporting on the Supreme Court for many years (and was a friend of the late Justice Ginsburg), and clearly has connections within the Court.

Would it be "theater" if Sotomayor drove by Gorsuch's home and took a potshot at it every working day? That would have roughly the same odds of harming him that his actions have of harming her. And it would be attempted murder.

More weakness from milquetoast Roberts. He should just refuse to allow Gorsuch to write any majority opinion until he starts behaving like an human.
