Somehow I feel like it's not Breyer. He seems arrogant enough to make the same mistake as RBG.

Yes it is Thomas isn't retiring he is healthy and neither is Alito

Regardless it's KENTAJI BROWN Jackson, I predicted that Breyer will retire it was 50/50

This will definitely energize D's for the Midterms, it's still 50/50. Breyer retired why would he stay on Biden is gonna get reelected anyways

Thomas retiring and his replacement being chosen by Joe Biden would be an irony of history after Anita Hill.

It's not going to happen, obviously, unless Thomas drops dead while Democrats have the senate.

Oh, I don't know. Possibly someone could offer his wife an extremely lucrative job on the condition that her husband retires from the court?

Inshallah

Lol Thomas would be a major nut!

This is why Biden can't just go nuts on Joe Manchin.

Please stop talking about nuts and nutting in a story being floated by Jeffrey Toobin.  We've suffered enough trauma.
Amen! If I see one more reference to nuts or nutting in this thread, I’m gonna bust

There's literally zero chance this happens. May if she'd ask Biden, but I guess Kamala still wants to be president.

However, I'd personally prefer nominating Kamala and replacing her with Gretchen Whitmer.

Obama wouldn't want the job. But Biden said during the 2020 campaign he would nominate him at request.

Kamala Harris would honestly be a terrific pick.  She's a very bright and qualified person who's on the right side of almost every issue, but seems to have horrible political instincts and no real electoral constituency.  She's a little only the old side, but just barely.  And this would allow Biden to nominate a new VP with actual appeal to Latinos.

Are you sure you are not trolling? Anyway, moving right along, I consider her many things, but a legal scholar who is a serious student of the law, has never, ever crossed my mind. Her asking questions in oral argument is something I am still trying to wrap my mind around.

Maybe its Sotomayor.  She has become increasingly mentally unhinged thanks to Covid and now refuses to be in the same room as unmasked people, despite presumably being fully vaccinated.  Since she's too afraid to attend in person work-related meetings, seems possible she's going to retire soon realizing that Covid is never going away.

I'm not sure what to make of this. All nine Justices are vaccinated and boosted, and Kavanaugh already had the virus.

Sotomayer has Type 1 diabetes which can dramatically increase risk even if vaccinated.

She was AG of the largest state in the country in addition to be a district attorney in several different contexts.  You don't need to a "legal scholar" as a career to be on the Supreme Court.  This is a very recent expectation of SCOTUS nominees that is not reflected in any law or constitutional provision, and was not even true of the vast majority of Justices until about 50 years ago.

Thomas retiring would of course be the best news imaginable, but I do believe he intends to die on the bench, possibly in the middle of oral arguments.

I'm aware that she has diabetes, and I know that until recently, she was the only Justice who was masked. It would probably be safer for her to participate remotely in any case, given the number of breakthrough infections we're now seeing.

I highly, highly doubt that either President or Michelle Obama - who would of course both make great Justices - would accept a nomination, but I kinda wish they would as their presence on the Court would drive the GOP absolutely batsh**t ing insane.

Obviously true since we have had many examples of those who demonstrably are not. Would I have appoint such a person? No. If even I can out lawyer them, I am not going to have them as a dance partner.
