1. The Region of Lincoln shall strongly encourage all middle schools and high schools in the region to offer a class dedicated to learning a foreign language.

2. $3,250,000 in funds shall be allocated to teaching students who’s native language is not english to learn English and improve their skills in their native language, in addition, teaching students with disabilities who’s native language is not English to learn English and improve their skills in their native language, in addition to developing a comprehensive curriculum for students who’s native language is not English.

3. $1,000,000 in funds shall be allocated to ensure that students with disabilities are treated fairly in schools.

Compliance
1. Criteria for being fined for mistreating students with disabilities or students who’s native language is not English in elementary, middle and high schools is as follows: denying school lunch or charging more for school lunches, denying access to higher academic programs for reasons not relating to the student’s test scores, school staff mistreating and unfairly punishing students with disabilities or students who’s native language is not English.
2. If the school has 100 students or less and is found to be mistreating students with disabilities or students who’s native language is not english, the minimum fine shall be $10,000 and maximum $25,000.
3. If the school has over 100 and less than 500 students and the school is found to be mistreating students with disabilities or students who’s native language is not english, the minimum fine shall be $15,000 and maximum $30,000
4. If the school has more than 500 and less than 1,000 students, found to be mistreating students with disabilities or students who’s native language is not english, the minimum fine shall be $20,000 and maximum shall be $35,000.
5. If the school has 1,000 or more students, found to be mistreating students with disabilities or students who’s native language is not english, the minimum fine shall be $25,000 and maximum fine shall be $50,000.
6. If a school is found to be unfairly treating students (to the best judgement of a Judge or Jury) with disabilities, that school is subject to a fine detailed above.
7. If a school is found to be unfairly treating (to the best judgement of a Judge or Jury)  students who’s native language is not English, that school is subject to a fine detailed above.

Effective Date

This bill will take effect on January 1, 2023

This bill will help Lincoln’s students with disabilities and student’s who do not speak English as their native languages. There have been many incidents at schools of special needs or students who don’t speak English being mistreated by school teachers and staff. This bill will finally change that, and make a brighter future for Lincoln’s students with disabilities or those who don’t speak English.

Nay

I oppose imposing such sweeping requirements on all middle and high schools as would be required by section 1, and find the fines rather extreme, especially as it may be hard to determine when a school is treating a student 'unfairly'.
