An Act
To Restrict the Development of Facial Recognition Technology (FRT)


Section I. Short Title

This Act shall be cited as the “FRT Restrictions Act”

Section II. Definitions

As used in the Act unless otherwise provided for or indicated —
(A) The term “facial recognition technology,” and “FRT” shall refer to any collection of hardware, software, and other computer programs which uses artificial intelligence to scan or otherwise analyze video footage, photographs, or any other image of a person or persons for any of the following purposes,
  • i. Matching captured faces against those within a database for the purposes of identification of any person or persons
  • ii.  Seeking to analyze or measure the emotions displayed by captured faces
  • iii. Measuring and modeling the specific facial movements of individuals for the purpose of identification or the analysis of emotion
  • iv. Any other means by which artificial intelligence may be trained to analyze captured faces for the purpose of  identification or emotional analysis

Section III. Usage by the Government of Lincoln

No department, agency, or subordinate authority of the Government of Lincoln, or any state or local governments within Lincoln, shall deploy or utilize facial recognition technology for any purpose

Section IV. Usage by Contractors

The Government of Lincoln shall not enter into any contract or otherwise provide any support for private institutions, for-profit or not for profit, which engages in the usage or development through research or any other means of facial recognition technology

Section V. Research Funding

The Government of Lincoln shall not provide funding to any research designed to promote or facilitate the development and deployment of facial recognition technology, and shall not provide funding or support to any institution which engages in such research

Section VI. Penalties

Any department, agency, or subordinate authority which is found to have violated or contrived to violate any provision of this Act shall be subject to one or more of the following penalties—
i. The head of the Department, Agency, or subordinate authority, if he or she shall have been found personally implicated in the infraction, may be fined a minimum of $250,000 per infraction, and an additional $100,000 for each day the department, agency, or subordinate authority was found to be in violation of the Act
ii. Any government employee found liable may be subject to a fine of at least $100,000 and the immediate termination of employment where such termination would not infringe on executive appointment power
iii. Any government employee found to have aided or participated may be fined a minimum of $50,000 per infraction, and may have his or her employment immediately terminated where such termination would not infringe on executive appointment power
iv. Any state of local authority found to be in violation of this Act may be subject to an injunction which would freeze all funding from the regional government which would otherwise be provided to the state or local authority

Section VII. Effective Date

This Act shall take effect three months after passage

The most important duty of government is to balance the safeguarding of the liberties of its people with their security, and while I would think that the wholesale regulation of facial recognition technology by private firms may go too far, I firmly believe that it is in the best interest of those we represent that we act as strongly as we can to prevent the development and deployment of a frankly dystopian apparatus of monitoring, tracking, and analysis which can easily be developed through the usage of facial recognition technology. While these systems may offer some benefits, the threat that they pose to civil liberties is far too great to be ignored, and we ought to take action to curtail these technologies before even more concerning ones are developed.
