Let’s say abortion is explicitly banned in 40-45 states
Uh, yeah, not going to happen. In the absence of Roe v. Wade you'd see heavy abortion restrictions (and even then not necessarily outright bans) in the deep south Bible Belt states + Utah and that's it.
Already about 18 states are planning on banning it, including some swing states… or at least former swing states.
Personally, I’d start with pre-natal child support and paternal liability for abortion unless the abortive father tried to stop it. Then maybe try to make funding for enforcement either harder or more exposed to the electorate. Maybe abortion courts that work the same as drug courts do?
