Unless we want to create a legal framework for "The Buck Stops Here" and hold Presidents legally responsible for every law broken by any member of the executive branch or military, I have a hard time seeing that case be made for Biden, at least as far as things like botched drone strikes go. Something like the prison at GITMO being sanctioned by each administration and Biden not making a good faith effort to relocate the prisoners there yet seem like a more solid case, but even that is a bit of a stretch for Biden specifically, at least at this point.
