My point wasn't that he's innocent, just that imo legally it is more difficult to get him on these charges than the classified documents. This is a pretty unprecedented situation so that makes it more legally complicated, while lots of people have mishandled documents and had the book thrown at them for it.

As far as the fake electors go, this is an open and shut case. It's indisputable that Trump and his lackeys conspired to reject the legitimate slates and admit the fake ones along with forged certificates.

So here’s an interesting question in my mind:
Suppose the election actually -was- stolen.  In this case, would Trump’s actions have been legal?

I think the answer is no…if the election was actually stolen, the remedy is present your evidence of this in court.  It’s not to appoint a slate of electors separate from the state certified slate and convince federal officers to ignore the state certifications, right?

So if this is true, it shouldn’t matter whether Trump knew or believed the election wasn’t stolen.  He’s guilty regardless.

I think the answer is no…if the election was actually stolen, the remedy is present your evidence of this in court. 

I guess Trump's argument would be that he already attempted to do that in the months before January 6 and that the courts had summarily dismissed his case (because the courts are also supposedly rigged against him).

I'm genuinely giddy with excitement that trump is about to meet something face to face that he has never met before in his life: someone with power over him who will throw him in jail without a second thought if he breaks this sort of gag rule he's under. I honestly don't think he makes it until the trial without being locked up.

Yes I was wondering about that, although Eastman could testify what he told Trump and there are his writings, so his counsel could argue that it was reasonable for Trump to rely on such advice. A tougher lift might be to persuade a judge that the opinion was facially plausible. The DC jury of course is not going to accept any of it. That raises the issue as to whether Trump can invoke the attorney client privilege to preclude testimony that all the other lawyers told him Eastman was crazy.

A problem there is that Eastman can't testify at all because he's a coconspirator his lawyer would tell him to take the 5th. That can be remedied if his trial goes first or he's given immunity but obviously Smith doesn't want to do that. Trump may make an issue out of this though as a delay tactic.

Jesus. This guy is beyond stupid. But there's a reason his staffers and attorneys always tried to avoid having him under oath, because he'd imediately incriminate himself since his lying is pathological.

There's clearly fear behind it, as his increasingly unhinged behavior shows. He should actually seek help from a psychatrist.
