The most significant sentencing so far in the Jan. 6 riots case occurred yesterday. Defendant Scott Fairlamb was sentenced to 41 months in prison, slightly less than the prosecution had requested (44 months), for assaulting a police officer and obstructing an official proceeding.  He had entered a guilty plea.

"It's such a serious offense ... an affront to society and to the law, to have the Capitol overrun and the function of government stopped," said Judge Royce Lamberth, noting that the assault had struck "in the heart of our democracy."

Fairlamb's sentence will likely set an early benchmark for how harshly rioters charged with violence may be punished, and it ushers in a new phase of the US Capitol riot cases, which so far have had only nonviolent defendants sentenced largely to no jail time.

Jacob Chansley, the "QAnon shaman", has been sentenced to 41 months in prison for his role in the Jan. 6 insurrection.  This was on the lower end of federal sentencing guidelines for the offense.

The latest batch of subpoenas indicates the committee continues to focus, in part, on organizers and funding of the "Stop the Steal" rallies that took place on January 5 and 6, as well as earlier rallies in the months leading up to the US Capitol attack.

Also subpoenaed by the committee Monday: Dustin Stockton and Jennifer Lawrence, key players in the "Stop the Steal" movement after the election.

The House committee investigating the January 6 insurrection issued five new subpoenas on Tuesday targeting right-wing extremist groups that were involved in the attack, including the Oath Keepers and Proud Boys.

The subpoenas went to the Proud Boys and its leader Enrique Tarrio, as well as the Oath Keepers and its leader Stewart Rhodes. Dozens of members of both groups have been charged in the attack on the US Capitol, and prosecutors have said they conspired ahead of time to disrupt the Electoral College proceedings. (Tarrio and Rhodes have not been charged.)

Exclusive: Meadows reaches deal for initial cooperation with January 6 investigators

Donald Trump's former chief of staff Mark Meadows is cooperating with the House select committee investigating the January 6 riot and is providing records and agreeing to appear for an initial interview, CNN exclusively has learned.

The move represents a critical shift in the relationship between the top Trump ally and the panel, and staving off a criminal contempt referral for now.

"Mr. Meadows has been engaging with the Select Committee through his attorney," Democratic Rep. Bennie Thompson of Mississippi who chairs the committee said in a statement. "He has produced records to the committee and will soon appear for an initial deposition. The Select Committee expects all witnesses, including Mr. Meadows, to provide all information requested and that the Select Committee is lawfully entitled to receive. The Committee will continue to assess his degree of compliance with our subpoena after the deposition."

The Capitol rioter accused of firing the Taser at one of the most outspoken police officers wounded on January 6 had told federal investigators in March he had come to Washington, DC, to respond to then-President Donald Trump's call -- and that he regretted what he had done.

The Justice Department released video on Tuesday of the extensive March 2021 interview two federal investigators did with alleged Capitol rioter Daniel Joseph Rodriguez. The 38-year-old Californian is accused of shocking Metropolitan Police Officer Michael Fanone with a stun gun amid an intense standoff between Trump supporters and law enforcement during the insurrection, and of participating in a conspiracy to attack of the Capitol. He has pleaded not guilty.

Justice Department prosecutors say they have evidence that an alleged rioter who brought a gun to the US Capitol on January 6 was targeting both House Speaker Nancy Pelosi and then-Majority Leader Mitch McConnell.

According to a filing Thursday, Guy Reffitt, a member of the Texas Three Percenter militia, "specifically targeted at least two lawmakers -- the Speaker of the House, Nancy Pelosi, and then-Senate Majority Leader, Mitch McConnell -- whom he sought to physically remove or displace from the Capitol building."

This particular old lawyer is flummoxed as to why a court is not involved here. It seems to me that Meadows etc could state that  they will not invoke executive privilege unless a court so enjoins him to pursuant to a Trump filed lawsuit within say 30 days. Or he could state to Congress that it should get a court order stating that executive privilege does not apply and compelling him to testify not invoking it. It seems ridiculous and very unfair to put a witness in criminal jeopardy over a dispute about the scope of executive privilege without having a court issue a ruling first.

Am I missing something here?
