January 6 committee releases resolution recommending holding Meadows in contempt of Congress

The House select committee investigating the January 6 attack on the US Capitol has issued a resolution recommending that the House of Representatives find Mark Meadows, former President Donald Trump's chief of staff, in contempt of Congress.

The resolution comes after the panel informed Meadows last week that it has "no choice" but to advance criminal contempt proceedings against him given that he has decided to no longer cooperate.

"The Select Committee is left with no choice but to advance contempt proceedings and recommend that the body in which Mr. Meadows once served refer him for criminal prosecution," committee Chairman Bennie Thompson, a Mississippi Democrat, wrote in a letter dated December 7.

Hopefully the DOJ decision will go more quickly now that they have recently been through it once.

Meadows has a better claim to executive privilege in general than Bannon, but the committee is limiting the complaint to his refusal to talk about material he's already given them. So hopefully that doesn't matter.

US Capitol rioter gets 5 years in jail after throwing fire extinguisher at police

A Florida man who enthusiastically attacked police at the US Capitol on January 6 with a fire extinguisher, a wooden plank and a pole was sentenced to more than five years in prison on Friday, the longest sentence for a Capitol rioter thus far.

Robert Scott Palmer is the first person to be sentenced for the felony of assaulting an officer with a dangerous weapon. His 63-month sentence could set a benchmark for the more than 140 others who face the same charge.

"Every day we are hearing about reports of antidemocratic factions, people plotting potential violence in 2024," District Judge Tanya Chutkan said as she handed down the sentence. "It has to be made clear that trying to stop the peaceful transition of power, assaulting law enforcement, is going to be met with certain punishment. Not staying at home, not watching Netflix, not doing what you were doing before you got arrested."

January 6 rioter gets nearly four years in prison for assaulting police officer

An Ohio man was sentenced to 46 months in jail for assaulting a police officer with a dangerous weapon in a tunnel at the US Capitol on January 6.

During the Capitol riot, Devlyn Thompson helped move police shields up a line of rioters in the tunnel, attempted to throw a speaker at police officers -- which ended up hitting and injuring a fellow rioter -- and eventually hit a police officer in the hand with a metal baton, according to court documents.

Judge Royce Lamberth of the federal district court in Washington, DC, said that while Thompson "deserve(d) credit" for his early cooperation, he couldn't "see a justification for going below" sentencing guidelines.

"The violence that happened that day was such a blatant disregard to the institutions of government," the judge said before handing down the sentence.

Trump asks Supreme Court to block release of his White House records to January 6 committee

Former President Donald Trump appealed to the Supreme Court on Thursday to block the release of documents from his White House to the House committee investigating the January 6 riot at the Capitol, escalating his effort to keep about 700 pages of records secret.

The House committee, which is charged with investigating the US Capitol attack to provide recommendations for preventing such assaults in the future, seeks the documents as it explores Trump's role in trying to overturn the election. That includes his appearance at a January 6 rally when he directed followers to go to the Capitol where lawmakers were set to certify the election results and "fight" for their county. The documents are currently held by the National Archives.

In filings submitted to the Supreme Court on Thursday, Trump asked the justices to take up a full review of the case and he requested that while they consider his position, they put a hold on the lower court decision permitting the disclosure of his records while they consider taking up the case.

"The limited interest the Committee may have in immediately obtaining the requested records pales in comparison to President Trump's interest in securing judicial review before he suffers irreparable harm," Trump's lawyers wrote in the court filings.

White House records obtained so far by January 6 committee show no record of calls to and from Trump during riot

White House call records now in possession of congressional investigators do not reflect calls made to or from then-President Donald Trump as the violence unfolded on Capitol Hill on January 6, 2021, leaving them with gaps so far in their understanding of what transpired that day, three sources familiar with the House investigation into the insurrection tell CNN.

The records the House select committee has obtained do not contain entries of phone calls between the president and lawmakers that have been widely reported in the press. Trump was known to make calls using personal cell phones, which could account for those.

Two of the sources, who have also reviewed the presidential diary from that day, say it contains scant information and no record of phone calls for several hours after Trump returned to the Oval Office after giving a speech to his supporters at the Ellipse until he emerged to address the nation in a video from the Rose Garden.

Republicans probably do take the House, but DOJ will keep going, and it's way too early to know what will happen in 2024. Also, 3 can't happen if 2 does.

House votes to refer 2 former Trump advisers to Justice Department for contempt of Congress

The House voted Wednesday to recommend two former advisers to former President Donald Trump be referred to the Department of Justice on criminal contempt of Congress charges.

The House select committee investigating the January 6, 2021, Capitol Hill riot is looking to hold Trump White House deputy chief of staff Dan Scavino and Trump's onetime trade adviser Peter Navarro in contempt of Congress for their refusal to cooperate with the panel's investigation or appear for their respective scheduled depositions.

The House vote was 220-203. Just two Republicans -- Rep. Liz Cheney of Wyoming and Rep. Adam Kinzinger of Illinois -- voted for the resolution. The pair also serve on the January 6 committee.

What's the likelihood of any of these things happening:

--Trump faces serious legal consequences from the outcome of this investigation.
--The investigation never concludes and is dissolved after the midterms by the new Republican Congress.
--The investigation concludes prior to the midterms, Trump is found to be criminally liable, the results are sent to the DOJ, but nothing of merit ever comes of it.

Maddow just played a tape on air of Kevin McCarthy very clearly telling Liz Cheney that he was thinking about calling Trump (Jan 10) and recommending that he resign. McCarthy denied today that he ever said he was going to tell Trump to resign.

January 6 committee issues subpoenas to 5 House Republicans including McCarthy

The House select committee investigating the January 6 attack on the US Capitol is taking the extraordinary step of sending subpoenas to House Minority Leader Kevin McCarthy and four other Republican lawmakers who have rejected the panel's requests to voluntarily cooperate.

In addition to McCarthy, the Democrat-led panel is subpoenaing Republican Reps. Jim Jordan of Ohio, Mo Brooks of Alabama, Andy Biggs of Arizona and Scott Perry of Pennsylvania.

Lawmakers on the panel have been weighing whether to subpoena their Republican colleagues for months, wrestling with whether they had the constitutional right to do so, and debating if they wanted to set such a precedent.

In its initial letter to McCarthy in January, the panel made clear it wanted to question him about his communications with former President Donald Trump, White House staff and others in the week after the January 6 attack, "particularly regarding President Trump's state of mind at that time."
