FF Act

An act that increase Firearm Freedom without removing the most important gun control provisions.

Title 9, Section 3 of the Consolidate Laws of Lincoln Omnibus Act is amended as follows:

An individual receiving a gun, either through sale or transfer, shall be required to undergo universal comprehensive background checks, with requirements determined by the Bureau of Firearm Safety and Licensing, which shall include —
(1) not being convicted of a violation of a gun law in the past 3 years from the date of application;
(2) not being convicted of a crime involving bodily harm or the use of a gun in the past 5 years from the date of application;
(3) not being convicted of a crime involving the use of a gun in the past 10 years from the date of application


Title 9, Section 4 of the Consolidate Laws of Lincoln Omnibus Act is amended as follows:

(a) In general. —

A “Gun License” shall be required to purchase, sell, or possess a gun in Lincoln.

(b) License types. —

There shall be the following categories of gun licenses —
(1) Class A, for rifles and shotguns; and
(2) Class B, for Class A weapons and handguns.

(c) Renewal. —

An individual shall be required to renew their Gun License every 310 years.

(d) Suspension. —

An individual's Gun License may be temporarily or permanently suspended by the court as a result of a criminal conviction relating to the violation of this Act, a violation of another gun law, the use of a gun in a crime, a crime involving bodily harm, or domestic violence.

(e) Requirements. —

An individual shall apply at a at a drivers license facility to get or renew a Gun License, where they shall —
(1) undergo a universal comprehensive background check;
(2) not have been adjudicated as a mental defective or committed to a mental institution by a court
(2)(3) show proof of passing a gun training and safety course at a drivers license facility or on a drivers license facility website; and
(4) pass a gun safety exam at such drivers license facility.

(f) Driver's licenses facility. —

The Bureau of Firearm Safety and Licensing shall provide to drivers license facilities the necessary courses for gun training and safety, accessible both —
(1) at the drivers license facility; and
(2) online.

(g) Waiting period. —

An individual shall not receive a gun license for the first time no sooner than one week (168 hours) after applying for one.


(g)(h) Failure to comply. —

An individual that shall violate Subsection (a) may face the following penalties at the discretion of the court —
(1) a fine not exceeding $100,000; or
(2) a term of imprisonment of no more than 10 consecutive years.

No individual shall purchase, sell, or possess
(1) bump stocks;
(2) suppressors;
(3)(2) magazines that hold more than 10 rounds of ammunition; and

(b) Penalties. —

An individual that purchases or sells, or possesses one or more of the devices in Subsection (a) may face the following penalties at the discretion of the court —
(1) a fine not exceeding $100,000; or
(2) a term of imprisonment of no more than 10 consecutive years.


Title 9, Section 8 of the Consolidate Laws of Lincoln Omnibus Act is amended as follows:

Any individual who is convicted of a crime involving the use of a gun may have any guns or gun accessories in the individual’s possession permanently confiscated by Lincoln at the discretion of the court.

(a) Guns. —

An individual who is convicted of violating a gun law, including this Act, may have any guns involved in or with such crime permanently confiscated by Lincoln at the discretion of the court.


(b) Bump stocks; suppressor; large magazines; semi-automatic assault weapons. —

An individual who is convicted of violating a gun law, including this Act, shall have any of the items listed in Section (4)(a) involved in or with such crime permanently confiscated at the discretion of the court.

The Assault Weapons Ban under Title 9 needs to be retained. There is a large amount of mass shootings that are being stopped by it that would suddenly happen if it were to be repealed. Particularly since the Federal Ban may be repealed in the coming weeks, it is imperative that the Lincoln Ban remain in Place.

If that can be done, I will support the bill.

My amendment fails 2-3.

Objecting to the AGA Amendment for the purpose of getting a vote on it.

We will now proceed to a combined vote on the amendments with votes pending. If both are adopted, we'll iron out discrepancies later. I've trimmed both proposals down to the changes they make from the OP for visibility:

I would also like to add that this bill still doesn't define "assault weapon," so if it's still going to be banned, there has to be some definition.



The definition is "semi-automatic rifles, semi-automatic handguns, and semi-automatic shotgun," pretty sure that the "or" is dividing the word and definition. I can contact the original sponsor of this to ensure that was the intent though.


A handgun can be an assault weapon? Or is the definition just "semi-automatic rifles."

pretty sure it's all four, but let me ask the original sponsor

Offering the following to clear up some confusing text, hopefully this can be done without a vote.

It has been confirmed in conversations with sponsors that 'or' was the intended dividing line for the definition of the term assault weapon.

24 hours to object to the amendment.

Assuming he still wants one, I'll hold a vote on AGA's amendment to strike the handgun ban once this one is done.

FF Act

An act that increase Firearm Freedom without removing the most important gun control provisions.

Title 9, Section 3 of the Consolidate Laws of Lincoln Omnibus Act is amended as follows:

An individual receiving a gun, either through sale or transfer, shall be required to undergo universal comprehensive background checks, with requirements determined by the Bureau of Firearm Safety and Licensing, which shall include —
(1) not being convicted of a violation of a gun law in the past 3 years from the date of application;
(2) not being convicted of a crime involving bodily harm or the use of a gun in the past 5 years from the date of application;
(3) not being convicted of a crime involving the use of a gun in the past 10 years from the date of application


Title 9, Section 4 of the Consolidate Laws of Lincoln Omnibus Act is amended as follows:

(a) In general. —

A “Gun License” shall be required to purchase, sell, or possess a gun in Lincoln.

(b) License types. —

There shall be the following categories of gun licenses —
(1) Class A, for rifles and shotguns; and
(2) Class B, for Class A weapons and handguns.

(c) Renewal. —

An individual shall be required to renew their Gun License every 410 years.

(d) Suspension. —

An individual's Gun License may be temporarily or permanently suspended by the court as a result of a criminal conviction relating to the violation of this Act, a violation of another gun law, the use of a gun in a crime, a crime involving bodily harm, or domestic violence.

(e) Requirements. —

An individual shall apply at a at a drivers license facility to get or renew a Gun License, where they shall —
(1) undergo a universal comprehensive background check;
(2) not have been adjudicated as a mental defective or committed to a mental institution by a court
(2)(3) show proof of passing a gun training and safety course at a drivers license facility or on a drivers license facility website; and
(4) pass a gun safety exam at such drivers license facility.

(f) Driver's licenses facility. —

The Bureau of Firearm Safety and Licensing shall provide to drivers license facilities the necessary courses for gun training and safety, accessible both —
(1) at the drivers license facility; and
(2) online.

(g) Waiting period. —

An individual shall not receive a gun license for the first time no sooner than one week month (168 730 hours) after applying for one.


(g)(h) Failure to comply. —

An individual that shall violate Subsection (a) may face the following penalties at the discretion of the court —
(1) a fine not exceeding $100,000; or
(2) a term of imprisonment of no more than 10 consecutive years.


Title 9, Section 6 of the Consolidate Laws of Lincoln Omnibus Act is amended as follows:

(a) In general. —

No individual shall purchase, sell, or possess
(1) bump stocks;
(2) suppressors;
(3)(2) magazines that hold more than 10 rounds of ammunition; and
(4)(3) semi-automatic assault weapons, or defined as semi-automatic rifles, semi-automatic handguns, and semi-automatic shotguns.

(5) bayonet lugs
(6) threaded barrels
(7) grenade launchers
(Cool barrel shrouds

(b) Penalties. —

An individual that purchases or sells, or possesses one or more of the devices in Subsection (a) may face the following penalties at the discretion of the court —
(1) a fine not exceeding $100,000; or
(2) a term of imprisonment of no more than 10 consecutive years.


Title 9, Section 8 of the Consolidate Laws of Lincoln Omnibus Act is amended as follows:

Any individual who is convicted of a crime involving the use of a gun any gun related offense, including any gun-related crime may have any guns or gun accessories in the individual’s possession permanently confiscated by Lincoln at the discretion of the court.

(a) Guns. —

An individual who is convicted of violating a gun law, including this Act, may have any guns involved in or with such crime permanently confiscated by Lincoln at the discretion of the court.


(b) Bump stocks; suppressor; large magazines; semi-automatic assault weapons. —

An individual who is convicted of violating a gun law, including this Act, shall have any of the items listed in Section (4)(a) involved in or with such crime permanently confiscated at the discretion of the court.

I'll note that the ban on semi automatic handguns aka pistols is taken from federal law, if this passes, it is in contradiction of federal law and someone will sue to overturn this law.

If filed, this could be solved with a simple ruling that states the obvious: The federal definition takes precedence for as long as it may exist. Lincoln is in this case simply delegating certain enforcement matters to the Federal Government.

The bill is passed, 3-2.
