FF Act

An act that increase Firearm Freedom without removing the most important gun control provisions.

Title 9, Section 3 of the Consolidate Laws of Lincoln Omnibus Act is amended as follows:

An individual receiving a gun, either through sale or transfer, shall be required to undergo universal comprehensive background checks, with requirements determined by the Bureau of Firearm Safety and Licensing, which shall include —
(1) not being convicted of a violation of a gun law in the past 3 years from the date of application;
(2) not being convicted of a crime involving bodily harm or the use of a gun in the past 5 years from the date of application;
(3) not being convicted of a crime involving the use of a gun in the past 10 years from the date of application


Title 9, Section 4 of the Consolidate Laws of Lincoln Omnibus Act is amended as follows:

(a) In general. —

A “Gun License” shall be required to purchase, sell, or possess a gun in Lincoln.

(b) License types. —

There shall be the following categories of gun licenses —
(1) Class A, for rifles and shotguns; and
(2) Class B, for Class A weapons and handguns.

(c) Renewal. —

An individual shall be required to renew their Gun License every 310 years.

(d) Suspension. —

An individual's Gun License may be temporarily or permanently suspended by the court as a result of a criminal conviction relating to the violation of this Act, a violation of another gun law, the use of a gun in a crime, a crime involving bodily harm, or domestic violence.

(e) Requirements. —

An individual shall apply at a at a drivers license facility to get or renew a Gun License, where they shall —
(1) undergo a universal comprehensive background check;
(2) not have been adjudicated as a mental defective or committed to a mental institution by a court
(2)(3) show proof of passing a gun training and safety course at a drivers license facility or on a drivers license facility website; and
(4) pass a gun safety exam at such drivers license facility.

(f) Driver's licenses facility. —

The Bureau of Firearm Safety and Licensing shall provide to drivers license facilities the necessary courses for gun training and safety, accessible both —
(1) at the drivers license facility; and
(2) online.

(g) Waiting period. —

An individual shall not receive a gun license for the first time no sooner than one week (168 hours) after applying for one.


(g)(h) Failure to comply. —

An individual that shall violate Subsection (a) may face the following penalties at the discretion of the court —
(1) a fine not exceeding $100,000; or
(2) a term of imprisonment of no more than 10 consecutive years.

No individual shall purchase, sell, or possess
(1) bump stocks;
(2) suppressors;
(3)(2) magazines that hold more than 10 rounds of ammunition; and

(b) Penalties. —

An individual that purchases or sells, or possesses one or more of the devices in Subsection (a) may face the following penalties at the discretion of the court —
(1) a fine not exceeding $100,000; or
(2) a term of imprisonment of no more than 10 consecutive years.


Title 9, Section 8 of the Consolidate Laws of Lincoln Omnibus Act is amended as follows:

Any individual who is convicted of a crime involving the use of a gun may have any guns or gun accessories in the individual’s possession permanently confiscated by Lincoln at the discretion of the court.

(a) Guns. —

An individual who is convicted of violating a gun law, including this Act, may have any guns involved in or with such crime permanently confiscated by Lincoln at the discretion of the court.


(b) Bump stocks; suppressor; large magazines; semi-automatic assault weapons. —

An individual who is convicted of violating a gun law, including this Act, shall have any of the items listed in Section (4)(a) involved in or with such crime permanently confiscated at the discretion of the court.

I got rid of some of the more strict measures of the law. In section 4, I increased the duration of a license from 3 to 10 years. I got rid of the provision where someone must pass a mental health evaluation because a physician cannot deny someone a constitutional right. In section 6, I removed the ban on suppressors. Suppressors provide a convenience to gun owners and help prevent hearing damage. A gun shot is still very loud with a suppressor, and there isn’t any evidence that banning them reduces gun homocides. I got rid of the ban on all semi-automatic guns. There isn’t much evidence that banning semi-automatic assault weapons and rifles reduces gun violence. It doesn’t seem that these bans are necessary considering the other gun control measures in the bill. I changed section 9 so that only someone convicted of a crime with a gun can be subject to confiscation. The current law allows for confiscation for merely possessing a banned firearm, which is dangerous and impractical.

There are two sections where I added additonal security measures, sections 3 and 4. In section 3, I added a provision preventing anyone convicted of a violent crime involving a gun from passing a background check for ten years. In section 4, I added a one-week waiting period, which has been shown to reduce suicides.

The Assault Weapons Ban under Title 9 needs to be retained. There is a large amount of mass shootings that are being stopped by it that would suddenly happen if it were to be repealed. Particularly since the Federal Ban may be repealed in the coming weeks, it is imperative that the Lincoln Ban remain in Place.

If that can be done, I will support the bill.

Yes, I object. Kind of defeats the point of the bill if all the gun control rollbacks are removed.

Amendment for consideration after Wulfric's, given the historical link between mental health and gun violence removing the need to pass a mental examination sounds frankly idiotic, to put it bluntly.

After some research, silencers make it very hard for police to locate active shooters, gunshots should remain loud so police can find these people and apprehend them in time.

Quite frankly, someone who has poor mental health should not be able to use a gun. Guns are extremely dangerous, and we have seen numerous instances where people with mental health issues have committed acts of gun violence, rejection of this amendment is frankly just asking for trouble.
