Depends on whether the Democrats retake the Senate, and if so by how much. In order to have any chance of adding seats to undo Republican court packing, they'll need more than a bare 50+VP.

Anywhere from 7 to 12 is possible. (I doubt Biden would go along with a plan to add more than 2 seats to the current court, but I could see him going along with a plan to add 2 seats now, and start having a president nominate a justice every two years which could get us to 12 if no one leaves the court. Conversely, 2 seats going vacant and a Republican Senate refuse to confirm is all too possible.

The reality is that as much as Democrats talk tough they won't pack the courts.  They just don't have the political willpower to do so.

If Barrett was confirmed today she still wouldn't actually hear any cases until AFTER the new President takes office.  Soooo …. failure to wait is just telling the American public that they don't get a vote.

She'd hear cases in November, & a new President doesn't take office 'til January 20th.
