I'm going to take this question and extend the analogy.  The woman is 8 1/2 pregnant and going to deliver in two weeks.  She has no health problems and the baby (at 8 1/2 months it is a baby) has no health problems.  It was not a case of rape or incest.  Is anyone out there, other than Opebo, really saying that this should be legal?  Would it be legal if she waited a week until after birth?

Jail-time for getting an abortion after the first trimester -probably no more than a couple years at most, with early release based on either bail or good behavior.

It should be legal within 90 days of conception.

After that, community service for first infraction, then a fine and community service for second, and community service/jail time for third.  Throwing black women in jail isn't the answer here, especially if they have families to tend to at home.

Yes, almost every state has a ban on third trimester abortions.  But some states (New York, New Jersey, Washington, Hawaii, couple others) don't and I get the feeling that nclib would oppose introducing these bans because third trimester abortions don't happen often.  If they don't happen often, that makes it that easier to ban them.

That said, the bans are effectively useless since they have to contain an exception for the health of the mother, which is a fairly broad term in reference to abortion.

The late term abortion bans are useless because any woman can just say they have mental trauma or something like that and get the abortion.  However, in some states, it will be hard to find someone to perform them.  Mississippi has only one abortion clinic and it only does up to 22 weeks.  South Dakota has only one clinic as well, which may be shut down soon.  So, we do have abortion on demand in the sense that you can get an abortion for pretty much any reason - but whether you can actually get that abortion depends on the restrictions and availability in your state.

There are people on the pro choice side who favor that and object to any regulation.  Granted, there are people on the pro-life side who feel that preventing fertilization should be a criminal act, or that abortion should even be illegal if the mother's life is in danger.

I think this is a very complex issue and attempting to state a position without a lot of qualifications is wrong.

Actually, in answer to your question, ardent pro-lifers would say that the woman might be too embarrassed to get one before that time.  People are out there making these arguments.

My point was that since unjustified late-term abortions are so rare, banning them would result in banning abortions done for health reasons.

It is clear that the main reason pro-lifers pushed the Partial Birth Abortion Ban was to chip away at abortion rights in general.
