My understanding is recess appointments automatically expire after roughly a year whenever the Senate does a sine die adjournment, so a situation develops where we have a fully manned court where Garland and others keep getting appointed via recess appointments until Tucker comes along, then the GOP lets the three recess appointments lapse and Tucker makes three full appointments.
