Its a clause about free elections . I gave the abbreviated answer.

That's true, but some of those clauses are more robust than others. I've also never seen a Republican judge/justice overturn a gerrymander under that criteria.

Mid decade redistricting isn't illegal in Maryland, so theoretically the state senate could Merrick Garland Hogan's remaining nominees and redistrict in 2024 with a friendly CoA, no?

True, though tbh MD-02 has kind of an insane swing from 2016 (43D-50R) to 2020 (50D-47R), so much so that it's hard to gauge, though I'd probably peg it as lean R.

The elephant in the room of course is NYS, where the legislature displayed hubris on steroids, and just ignored the Constitution regarding gerrymandering as if it were not there. They were that confident about the hack quotient of NYS higher courts. We shall see.

Well that is playing the card of making the court draw the map, so it is only good for two years, and then pack the court one way or the other to ramp up its hack quotient. Too bad there isn't a hell, because if there were, they would all be going to hell for the redistricting sins.

Should have been done last time. The previous Maryland map has to be in the competition for one of the worst looking drawings of all time, on par with the gerrymanders of old. And we get some pretty good and fair maps in return!

Will be interesting to see what happens when this goes to the state supreme court. The majority is Hogan appointees, but I believe that he's predominately appointed folks who would be labeled moderate Democrats/liberals.
