If she wants to have an FBI investigation first, then they might as just go on and vote on him.

Ford and her lawyers know damn well that the Republicans aren't going to wait for any investigation of any kind. So if she doesn't want to testify, just go on and hold his nomination vote.

If she wants to have an FBI investigation first, then they might as just go on and vote on him.

Ford and her lawyers know damn well that the Republicans aren't going to wait for any investigation of any kind. So if she doesn't want to testify, just go on and hold his nomination vote.

The notice of cancellation for Thursday already went out, and the hearing is already scheduled for Monday, so the earliest they could vote in committee is next Tuesday, and the earliest date for the final floor vote would be next Friday.

If she is reluctant to testify it is understandable. Senate Republicans are ready to attack on her.
If she's going to put herself out there like this, then she should be ready to face the consequences.

IMO, she should either face the music and testify publicly or rescind her story.


She should be asked questioned by Senators, not attacked. Just because she put her story out there does not mean she should be attacked under oath.

At a certain point this is ridiculous.  Witnesses who put together this sort of account events ought to be cross-examined.

If you were a nominee and someone had made an allegation against you that was false, but would destroy your reputation if it were allowed to stand, how would you wish the interrogating body to proceed?

Cross-Examination is appropriate in a proceeding like this.  There is a difference between asking about inconsistencies in accounts of the event and asking a witness if she led young Brett on, only to play the tease, or some tacky garbage like that.  

That being said, I am now of the opinion that Trump should pull the plug on the whole thing.  None of this is good for the SCOTUS and none of this is good for America, IMO.  Americans have an interest in the orders of their Courts being taken seriously and being obeyed.  That doesn't just happen, and it will be a step away from that if a nominee with the kind of allegation Kavanaugh has hanging over him (one that probably will never be fully proven or disproven) actually becomes a Justice.  "Mr. Justice Kavanaugh."  There is a problem when such a title appears oxymoronic to a large chunk of America.

Kavanaugh is tainted, and he was already an unpopular nominee. I get that conservatives think it's unfair that a simple accusation can short-circuit a USSC nomination, but there is a little more to this than a last-minute accusation, which means they can't just blow it off. At the end of the day, image matters greatly at this level of government, and this is too much for the court. Especially given #MeToo. The judiciary's reputation has been taking a beating for a long time now, and the last thing it needs is for Republicans to ram through an unpopular nominee accused of attempted rape during a period of time where there a movement against sexual harassment across the country.

Just because you have power doesn't mean you should stop caring how that power is used.

If the accuser really were lying, would it not make sense to wait until after Democrats retake the Senate, come out then, and try to get him to resign or impeached?

As it is, even if the accuser succeeds and gets the nomination withdrawn, the Republicans have plenty of time to get someone else confirmed by January. The timing of the accusation makes it very unlikely that it affects the ideological balance of the Court. This is evidence (though obviously not proof) that she's not outright lying.

Xavier Becerra, Attorney General of California should investigate these death threats, and prosecute the people responsible for making such threats. If you live in California, please send him an email.

No,  the local district attorney should do so. And something tells me that if they can trace it to a particular i p address that they will. Kindly don't bother the California attorney general with such nonsense

After death threats removed her from her home, which I'm sure she expected, why on Earth would she want not to testify.  Roll Eyes

BTW, why I have some reservations about a poorly performed polygraph, they can be fairly accurate. Good to see all the apologist initially demanding one having drop silent once Ford pass when administered by the FBI.

It’s obviously way more important to hold to an arbitrary schedule than to get to the bottom of something like this.

I don't see how this course of events really bolsters Ford's story or Democrats' chances.  If anything, her refusal to testify will be popularly interpreted as being that she probably made the whole thing up to begin with anyway (liars have a penchant for backtracking once they get too deep in, after all).

If she wants to testify, why threaten not to unless the FBI breaks SOP and reviews the facts in a matter not under criminal investigation?  Her attorney knows full-well what the FBI's response will be. 

The right thing for Ford to do is testify before the committee on Monday so that her story can be heard and can go on record.
