and Breyer (80),

In all seriousness though, I would not worry about it. Based on the info we have at the moment of me writing this, it appears the senate will have a composition of 48-52 in either direction. This all but guarantees that the senate will fall to the Democrats in either 2018 or 2020. This means that the two justices would have to live for at least 2-3 more years. If Trump is elected again, then the senate will dig its heels in. If not, then the justices will be immediately replaced.

I would not worry about the two justices. Their current condition is great, and justices have access to some of the greatest healthcare and medical treatment we currently have.

Each president should appoint a justice on their inauguration day rather than when one dies. The number need not be set at 9 or anything else.

Right now its luck as to which presidents appoint how many justices.

8-1 decisions on issues of economics and human rights, predictably endorsing a high-tech version of feudalism in which class privilege is the highest of all purposes in human existence and all else is subordinate, with Sonia Sotomayor as the sole dissent... those dissents being widely admired and the decisions themselves deprecated almost everywhere else.

Of course USSC decisions under the Trump-endorsed Court majority might be so incompetently written that they would have holes practically inviting nullification at the first opportunity. The idea that capital has precedence over all else (the Trump position) or that the partisan advantage established under GOP legislation to deny voting rights or even meaningful choice  to 'untrustworthy' people (perhaps laws requiring people to vote as their employers dictate, or state laws disestablishing the Democratic party) is to be enshrined.

The nightmare of single-Party government that we might never shake off except in a revolution or the wake of a defeat such as those of the fascist powers after World War II  is an ominous possibility.

It's a tradition for SCOTUS Justices to die with their boots on.

Do we want an "apolitical" SCOTUS?  Or do we want a politicized SCOTUS with Justices who agree with us and will be Judicial Activists in the direction we wish them to be.  And, to be sure, the "conservative" SCOTUS Justices are equally activist; Citizens United is one of the rankest pieces of Judicial  Activism in my lifetime (although Roe v. Wade takes the cake on that).

If the acceptable norm is a politicized SCOTUS, with Justices EXPECTED to follow the dictates of those that appointed them, then let's be honest about that.  In that case, Ginsburg and Breyer WERE wrong for not resigning on the day Obama took office.  But a better solution might be to limit the terms of SCOTUS Justices, with no possibility of reappointment.  I would advocate a Constitutional amendment limiting a Federal Court appointment to 10 years at each level and no more than fifteen (15) years on the SCOTUS.  That's plenty of time to provide for institutional memory and for a spirit of adherence to Stare Decisis without having Justices remain on the Court until they are 95 years old, senile and incontinent.  (And we've had that in our history; Mr. Justice McKenna being an example.)
