I could maybe, slightly, somewhat understand this defense if the man was actively trying to sexually assault the guy... but in this case it's obviously absurd.

That already exists, it's called self-defense.

And it doesn't depend on sexual orientation.
Hence the extra emphasis on "maybe, slightly, somewhat"... this entire defense is dumb and frankly offensive.

Hopefully stories like this will lead to more states repealing these disgusting laws.  Thank you Speaker Madigan and Gov Rauner for leading the charge!

Key word is "former cop". Many jury members refuses to convict anyone who ever was a cop.

What I gathered, is if if some guy hits  on you, is that it is legal to argue that that can lead to one becoming criminally insane (e.g., you think you are killing a Ken Doll rather than a human being). That seems insane. And it isn't a hot blood "defense,": i.e., a guy hitting on you is a reasonable basis for claiming it drove you into a homicidal rage, because that is "merely" voluntary manslaughter, and not murder.

It's first degree murder and he should face the maximum penalty for said crime. It's crimes like these that make me question my opposition to the death penalty. I'm more inclined to give a former police officer a harsher sentence because they should already know better.

Wow, I thought this argument was deemed non-admissable after the Jenny Jones murder case, Hopefully for states ban this argument
