In some states, someone can be arrested for failing a breathylizer test under 21, even if they aren't in possession of anything alcoholic and aren't behind the wheel. What's your opinion on this?

(I'm not asking how you feel about the drinking age itself)

I would think such laws remove an incentive not to drive drunk.

In which case there is even less of a reason for the public drinking age to be 21.
