On June 27, 2006, The Senate vote on a constitutional amendment banning flag burning was 66-34. Every nay vote was needed it for it fail to get 2/3rds.

3 Republicans voted nay. Chafee, now a Democrat. Benett, who came in 3rd place in the next primary. And Mitch McConnell, now Senate Majority Leader.

Dorgan, who often considered a blue dog on Pernament Trade Relations with China, also should have affirmed the constitutional amendment.
